<br />In the context of this use management standard, because the 1-5 replacement bridges (1) are not <br />designed solely for recreational use; (2) would be elements of an interstate highway; and (3) are not <br />being rebuilt due to a disaster, this use management standard requires an amendment. Accordingly, <br />the applicant proposes that the standard be amended to read as follows on page 155 of the <br />Willamette Greenway Section in the Willakenzie Area Plan Neighborhood Design Element, with <br />bold text indicating new text: <br /> <br />D. Replacement or expansion of the 1-5 Willamette River Bridge and its <br />approaches. <br /> <br />The proposed text amendment would allow the portions of the 1.,.5 Willamette Bridge Replacement <br />project within the setback to occur. Furthermore, as found previously under Goal 2 above, an <br />exception to Goal 15 is warranted in this case to allow the 1-5 Willamette Bridge Project to place fill <br />within in the Willamette River. As amended, the proposal is consistent with this policy. <br /> <br />Use Management Standard <br />2. Provision for public pedestrian and bicycle access along the river. <br /> <br />As previously discussed under Statewide Planning Goal 8 (see Exhibit A) which is incorporated <br />herein by reference, the bicycle and pedestrian trails will, to the maximum extent practicable, be <br />kept open, safe, and useable during project construction. Although it is possible that the existing <br />bicycle/pedestrian pathways will be interrupted during construction, the applicant proposes that a <br />continuous route across ODOT right-of-way for the bicycle/pedestrian pathways will be maintained <br />on both the north side and the south side of river during construction. The project will not have a <br />long-term effect on existing bicycle/pedestrian access along the river, consistent with this policy. <br />Furthermore, through the other local permitting processes (Willamette Greenway pennit, Water <br />Resources Conservation Overlay review, Willamette Greenway setback, etcetera) construction <br />impacts will be minimized through compliance with applicable approval criteria, related standards <br />and any necessary conditions of approval to preserve bicycle, pedestrian and boater safety. <br /> <br />Use Management Standard <br />5. Activities or uses such as open storage of materials shall be discouraged within the green way. <br /> <br />The applicant indicates that two staging areas for material storage and stockpiling, equipment <br />storage, job trailers, employee parking, and other construction-related uses would be occupied <br />during construction; one on the north side of the river and one on the south. The currently-proposed <br />staging areas would be located on ODOT right-of-way, but would also require the temporary <br />occupancy of three parcels not currently owned by ODOT (including portions of the Whilamut <br />Natural Area and Eastgate Woodlands) within the greenway and adjacent to 1-5. ODOT will acquire <br />temporary easements for use of non-ODOT property during construction and proposes to revegetate <br />all disturbed areas. Although both of these storage areas are within the greenway boundary and <br />given the temporary nature of the storage for construction of the bridges, the proposal is consistent <br />with this policy as it will not include long-term or permanent storage. In addition, through the other <br />local permitting processes (Willamette Greenway permit, Water Resources Conservation Overlay <br />review, Willamette Greenway setback, etcetera) construction impacts will be reviewed in detail and <br />minimized through compliance with applicable approval criteria, related standards and any <br /> <br />Exhibit B - Findings <br />Page 6 <br />
