<br />plans of affected governmental units and that opportunities be provided for review and comment by <br />affected governmental units. To comply with the Goal 2 coordination requirement, the City <br />coordinated the review of these amendments with all affected governmental units. Specifically, <br />notice was mailed to the State Department of Land Conservation and Development, Oregon <br />Department of Transportation (ODOT), Lane County, and the City of Springfield. Lane County and <br />the City of Springfield are participating in this amendment. <br /> <br />Part II - Exceptions <br />Part II of Goal 2 provides the conditions and standards for which a local jurisdiction can adopt an <br />exception to a statewide goal. Relevant to this request is Statewide Planning Goal 15, Willamette <br />River Greenway which does not allow non water-dependent, non water-related uses, such as the <br />proposed transportation facility, within the greenway setback without receiving an exception. <br />Because a goal 15 exception is required by D.ll of the Metro Plan, it is unnecessary to determine if <br />Goal 15 itself would require such an exception. The need for a goal exception is specifically <br />triggered by Policy D.ll of the Metro Plan, Willamette River Greenway, River Corridors, and <br />Waterways Element, which states: <br /> <br />D.11 The taking of an exception shall be required if a non-water-dependent transportation <br />facility requires placing of fill within the Willamette River Greenway setback. <br /> <br />An exception to Statewide Planning Goal 15 Willamette River Greenway was <br />approved for Oregon Department of Transportation (ODOT) 1-5 right of way <br />crossing the Willamette River and within the Willamette River Greenway Setback <br />Line, for purpose of constructing a temporary detour bridge, implementing the <br />conditions imposed on the Discretionary Use Approval (Springfield Journal SHR <br />2003-00115) and removing the temporary detour bridge after completion of the <br />permanent replacement bridge. This exception satisfies the criteria of Oregon <br />Administrative Rule (OAR) 660-004-0022(5) Willamette Greenway; the exception <br />requirements of OAR 660-004-0020 Goal 2, Part JI(c) for a 'reasons' exception; and <br />pursuant to OAR 660-004-0015, is hereby adopted as an amendment to the Metro <br />Plan text, Policy #D.ll, Chapter III, Section D. <br /> <br />The taking of an exception is consistent with Policy D.ll as the proposal includes the placement of <br />fill within the Willamette River Greenway setback for a non-water-dependent transportation <br />facility, and is consistent with the Goal 15 exception previously taken for the temporary bridge, as <br />described under Policy D.ll above. To acknowledge the 1-5 Willamette Bridge Project, Metro Plan <br />Policy D.ll is proposed to be amended as follows in bold: <br /> <br />An exception to Statewide Planning Goal 15 Willamette River Greenway was approved <br />for Oregon Department of Transportation (ODOT) for purposes of removing and <br />replacing the decommissioned 1-5 bridge, the temporary detour bridge and the Canoe <br />Canal bridge with two new parallel bridges (one southbound and one northbound) <br />within the 1-5 right-of-way crossing the Willamette River and Canoe Canal and within <br />the Willamette River Greenway Setback Line. The exception authorizes construction <br />and later removal of one or more temporary work bridges; demolition of the <br />decommissioned 1-5 Willamette River Bridge, Canoe Canal Bridge, and detour <br /> <br />Exhibit A - Findings <br />Page 3 <br />
