<br />Commissioner Rust stated it was Springfielg's prerogative because of <br />proximity: and Springfield's future need for expansion. However, <br />Mr. Rust had a strong feeling about the agricultural land as he was <br />involved in the zoning of it. Springfield declared that the urban growth <br />boundary had already been drawn back once. The discussion ended on <br />item 18. <br /> <br />Item 19 - status of Confluence Island and Pudding Creek and item 20 - <br />definition of availability, had been examined previously. <br /> <br />Item 21 - conflict with HB 2754, was deliberated. The language is clear. The <br />language _that was referred to in the public <br />testimony is preamble language to HB 2754. <br />The language referred to in the public <br />testimony is a finding in the bill, and as such, <br />. was not incorporated into Oregon Revised. <br />Statutes. The finding uses the term "may," <br />which is discretionary, rather than "shall," <br />which is mandatory language. <br /> <br />There was no support from the Board for any action on item 21. <br /> <br />The Board went on to item 22 - expansion of the urban growth boundary <br />north of Barger Road. Harold Rutherford recommended including the <br />Wildish property and item 23 - Gordon Elliott's property, in the urban <br />reserve. designation. Scott Lieuallen asked for comments from the City <br />Councils. <br /> <br />Cynthia Wooten stated that Eugene disagreed with item 22. Springfield <br />deferred to Eugene. <br /> <br />Otto t'Hooft felt there should be equal treatment, not special treatment, <br />for Gordon Elliott's land, as for other lands. The land is outside the <br />urban growth boundary and is not in close proximity to services. <br /> <br />MOTION: <br /> <br />Harold Rutherford MOVED and Otto t'Hooft SECONDED <br />designating the Wildish property as urban reserve. <br /> <br />Discussion continued on item 23. Harold Rutherford stated that the <br />Elliott property had been recommended for a designation of urban <br />reserve by MAPAC. He felt it should be included in the urban growth <br />boundary as it is in an area where services will be extended and it is a <br />logical location for urban development. <br /> <br />Jerry Rust deferred to Eugene City Council as it is Eugene's urban <br />growth boundary that is involved. <br /> <br />IV-A-18 <br />
