<br />e <br /> <br />e <br /> <br />e <br /> <br />Mr. Wong said the Business Assistance Team (BATeam) had requested that considera- <br />tion be given to making changes in the City Code regarding street vendors. He <br />sai d that staff had prepared an amendment to the code to allow street vendi ng <br />and that rules and regulations would be developed over the next 60 days to <br />control such things as the time and location for such vending. Mr. Wong said <br />that in the interim conditional licenses would be issued. <br /> <br />Mr. Sloat said that the request for this amendment had been made by Arthur <br />Golden and that the BATeam felt the change was appropriate because it would make <br />Eugene's ordinance more like those of other Oregon cities, because it would <br />provide a legitimate avenue for those wishing to start small businesses, and <br />because a number of unregulated street vending activities are currently occurring <br />in the City. He said staff recognized that regulations would need to be developed <br />to accompany the amendment to control such things as the time, place, and manner <br />of street vending. <br /> <br />Responding to questions from Councilor Holmer, Tim Sercombe, City Attorney's <br />Office, said that the change in Section 4.860 of the ordinance was proposed <br />since the language was vague and the topic of amusements on public streets would <br />be covered elsewhere in the code. Mr. Sercombe said that under Section 3.345 of <br />the ordinance, only written orders for future delivery would be required to be <br />made in duplicate, and duplicates of orders for present conveyance would not be <br />required. <br /> <br />Councilor Wooten asked how the ordinance would apply to flower vendors. She <br />wondered if the owner of a street-corner flower vending business with a number <br />of people working for him/her would need to get separate licenses for each <br />vendor. Ms. Grondona responded that each vendor would need a license. Responding <br />to further questions from Ms. Wooten, Ms. Grondona said that licenses would be <br />issued through the Business License Office and that the City Manager would issue <br />rules governing street vending. <br /> <br />Councilor Wooten asked what effect the ordinance would have on vending on the <br />downtown mall. Mr. Sercombe responded that the regulations to be developed <br />would probably exclude the mall and City Parks from coverage by the ordinance, <br />since these areas are governed by existing, separate regulations and processes. <br />Mr. Sercombe noted that the proposed regulations for the street vending ordinance <br />would be brought to the council for information and comment. Councilor Wooten <br />felt that the proposed ordinance was a good idea and would bring vitality to the <br />City and encourage small business development. <br /> <br />Councilor Hansen asked if regulations would be developed to prevent vendors from <br />locating in such a way as to compete with existing businesses. Mr. Sercombe <br />said this will need to be examined. He said vendors would not be allowed to <br />locate in such a way as to prevent or limit access to commercial operations. <br />He noted, however, that there were anti-trust concerns with the City's attempting <br />to limit competition.
