<br /> - <br />October 3, 1985 <br />To: City Council <br />From: war~~~Wong, Finance Director e <br />Subject: Compromise and Settlement of Claims <br />The attached ordinance provides for delegation of expressed authority to the <br />City Manager (Finance Officer) to compromise claims due the City. Staff and <br />the City Attorney have previously assumed that the City Manager, as the City.s <br />Business Agent, had authority to compromise claims due the City. Based on <br />the recent issue concerning the Interest on Usegregated Taxes due the City <br />from Lane County, the City Attorney has recommended that this authority be <br />formalized. Further, this expressed authority will reduce the personal <br />liability risk to Councilors. <br />Staff will continue to pursue all claims 'due the City within a reasonable <br />expenditure of resources, materiality limits and return on effort. You will <br />note that in situations where the claim is supported by a lien against real <br />property, such as in the case of a Bancroft Assessment, we will not compromise <br />the claim since it will ultimately be paid by either collection or foreclosure <br />and subsequent resale. <br />cc: M.
