Staff has been <br /> e working very closely on this matter and has resolved the issue. The <br /> assessment cost to the applicant was determined by land value of <br /> adjoining properties and existing improvements within the subject <br /> area. <br /> b. "The second is the issue of transportation, in particular the <br /> loss of access and egress between Franklin Boulevard and Bean <br /> parking lot." <br /> The issue of transportation will be reviewed as part of other <br /> criteria occurring in a subsequent portion of this consideration. <br /> c. "The third issue is the disposition of previous promises from <br /> Tom Williams to the neighborhood (and also the City?) about <br /> improvement of land between the bakery and Franklin Boulevard <br /> made in connection with previous expansion of the bakery." <br /> Staff has reviewed this matter and finds that Williams Bakery is <br /> supportive of improving the landscaping on the north side of 13th <br /> Avenue west of Moss Street. However, since the land is not in its <br /> ownership, a cosponsored improvement must be agreed upon by the <br /> University, owners of the property. The bakery has indicated to <br /> staff its desire to see the triangle of land developed and <br /> landscaped'based upon an acceptable plan, property owners agreement <br /> to maintenance responsibilities and liabilities, and what portion of <br /> e the triangle west of Williams Bakery ;s to be included. <br /> ~~ny of the items above occur as conditions of approval and are therefore <br /> suoject to an approved vacation. The agreed upon assessment cost has been <br /> paid and will be held in escrow until council action on the subject proposal. <br /> Section 7.6l0(3)(a)(2): Public services, facilities, or utilities can <br /> be extended in an orderly and efficient manner. <br /> The area is presently receiving public services from existing facilities <br /> located in the subject area or adjacent public rights of way. These can be <br /> relocated or redesigned to continue providing a complete range of urban <br /> services. Existing public rights of ways in the area provide for future <br /> extension of utilities in an orderly and efficient manner. The grid-type <br /> street and alley system does not appear to be critically severed in such a <br /> manner to restrict or eliminate future service of utilities (see attached <br /> vicinity map.) <br /> Section 7.6l0(3)(a)(3): Vacation is consistent with applicable <br /> transportation plans. <br /> Moss Street and other streets and alleys south of Franklin Boulevard were <br /> dedicated as public right of way with the Amended Plat of Fairmount <br /> Subdivision.
