ATTACHMENT A <br />ORDINANCE NO. <br />AN ORDINANCE CONCERNING FIREWORKS RESTRICTIONS AND <br />AMENDING SECTIONS 4.934 AND 4.996 OF THE EUGENE CODE, 1971. <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br />Section 1. Section 4.934 of the Eugene Code, 1971, is amended to provide as follows: <br />4.934 Fireworks Restrictions. In addition to restrictions on the sale, possession, use, <br />detonation or explosion of fireworks under state law, it is unlawful to: <br />(1) [u}Use, light, detonate or display any consumer fireworks anywhere in the city <br />at any time except on December 31, January 1, July 3 or July 4 [jURe 23 <br />"Tem„ july 6 eF ethear times -As zed by— the -e+ty manage., i - <br />ad Tstra#+ve-pates opted puFswaRt te seetiep 2.0 -19 A -f this rue -e. FA- F <br />puFpeses"iriseve6tl FiFewefl4s" Ips the mea^i g gRFep aAA--Q r'QgerR <br />n,_.,-,i.,i1S+,-.,+i.,,, Rule -27 912 0619 (294441. <br />(2) Use, light, detonate or display on December 31, January 1, July 3 or July <br />4 any consumer fireworks that produce audible effects, such as bangs, <br />whistles or screeches, that are plainly audible fifty feet or more from the <br />consumer fireworks. <br />(3) Use, light, detonate or display any display fireworks anywhere in the city <br />at any time except July 3 through July 5, unless specifically authorized <br />by the city manager or designee. <br />For the purposes of this section, "consumer fireworks" and "display fireworks" <br />have the meanings given in ORS 480.111. <br />Section 2. Subsection (8) of Section 4.996 of the Eugene Code, 1971, is added to provide <br />as follows: <br />4.996 Administrative Civil Penalty. <br />(8) In addition to, and not in lieu of any other enforcement mechanism <br />authorized by this code the city manager or designee may impose upon <br />the person responsible for violation of section 4.934 of this code, an <br />administrative civil penalty as provided by section 2.018 of this code. <br />Section 3.
