Appendix E <br />Instructions for Reporting of Trade Secret Chemicals <br />Four reports are required for reporting trade secret chemicals. All except 43 below are included <br />in this appendix. <br />1. Substantiation to Accompany Claims of Trade Secrecy Under Eugene Charter Amendment IV <br />A manufacturer reporting under Charter Amendment IV files this form with the Fire Marshal <br />prior to commencement of procurement or production of each trade secret chemical. This report <br />remains confidential. <br />2. Notice to Toxics Board of Trade Secret Reports Filed with the Office of the Fire Marshal <br />A manufacturer files this form with the Toxics Board when it files one or more substantiation <br />forms with the Office of the Fire Marshal. This form is available to the public. <br />3. Agareaate Materials Accounting of Trade Secret Chemicals <br />If more than one trade secret chemical is claimed, an aggregate accounting of the inputs and <br />outputs of all trade secret chemicals is entered into the manufacturer's public materials <br />accounting report as a separate line. Due April 1 of each year. <br />4. Public Report of Precautions in Use and Alternatives to Use of Trade Secret Hazardous <br />Substances <br />This form is completed by a Toxics Board-certified independent auditor for each trade secret <br />chemical, and submitted by the manufacturer to the Toxics Board prior to April 1 of each year. <br />This form is available to the public. <br />Businesses are advised to track their use of ALL reportable hazardous <br />substances, including trade secret chemicals, whether or not they believe <br />they will be required to report that use. Tracking is important in preparation <br />for required audits, and in the event that a business adds a trade secret <br />chemical during a reporting year (triggering the requirement for aggregate <br />materials balance accounting) or has a trade secret claim denied. <br />Reports and questions should be addressed to: <br />Eugene Toxics Program Staff c/o Eugene Springfield Fire Marshal/Eugene Toxics Board <br />1320 Willamette Street, Eugene, OR 97401 <br />541-682-7118 or Toxics*ci.eugene.or.us <br />-47- <br />
