<br />e <br /> <br />Responding to a question from Mr. Nicholson, Mr. Lyle said that the City <br />would have great difficulty constructing sanitary sewers in these basins <br />without these easements; if it were possible to reroute sewers, it would be <br />extremely costly to reroute sewers. . <br /> <br />Mr. Gary said that some tax benefits are given to property owners whose prop- <br />erty is acquired under threat of condemnation. The resolution enables prop- <br />erty owners to derive the benefit of condemnation without having to go <br />through the proceeding. In addition, Mr. Gleason said that once the City has <br />determined that it needs a right-of-way, it is compelled by statute to pro- <br />ceed with that action. <br /> <br />Mr. Boles asked that the benefits of condemnation to the property owners be <br />specifically outlined and that it be specified to which jurisdictions the <br />costs of those benefits are incurred. <br /> <br />CB 4309--An ordinance authorizing the institution of proceed- <br />ings in eminent domain for the acquisition by condem- <br />nation of property interests in River Road basins 0, <br />E, and F for the purposes of construction of sewer <br />improvements; and declaring an emergency. <br /> <br />e <br /> <br />Mr. Boles moved, seconded by Ms. Bascom, that the bill, with <br />unanimous consent of the council, be read the second time by <br />council bill number only, and that enactment be considered at <br />this time. Roll call vote; the motion carried unanimously, <br />6:0. <br /> <br />Council Bill 4309 was read the second time by number only. <br /> <br />Mr. Boles moved, seconded by Ms. Bascom, that the bill be <br />approved and given final passage. Roll call vote; all coun- <br />cilors present voting aye, the bill was declared passed (and <br />became Ordinance 19774). <br /> <br />XII. APPROVAL OF MINUTES, FINDINGS, AND RECOMMENDATION OF HEARINGS OFFICIAL <br />AND ADOPTION OF RESOLUTION FORMING A LOCAL IMPROVEMENT DISTRICT FOR <br />SANITARY SEWERS IN THE RIVER ROAD AREA FOR BASINS D, E, AND F <br /> <br />City Manager Mike Gleason introduced the topic and indicated that les lyle <br />was available to answer questions. <br /> <br />Mr. Boles moved, seconded by Ms. Bascom, to approve the Hear- <br />ings Official's minutes, findings, and recommendations for <br />sanitary sewers in the River Road area for Basins 0, E, and F. <br /> <br />Responding to questions from Mr. Green, Mr. lyle said that the City has the <br />authority through the Boundary Commission to extend facilities into that area <br />extraterritorially.
