<br />(1499) <br /> <br />e <br /> <br />0564 ) <br /> <br />e <br /> <br />- <br /> <br />Mr. Murray moved seconded by Mr. Keller to recommend approval of the license. <br /> <br />In making the motion, Mr. Murray noted that no zone change was involved nor was the <br />license granted by the Council, the only action here being to make recommendations <br />to the OLCC. He couldn't see how the proposed restaurant would aggravate what <br />was already allowed in that area, calling attention to nearby establishments which in <br />terms of serving alcoholic beverages went far beyond what was requested by this <br />applicant. <br /> <br />In response to Councilman Bradley for criteria on which to base the Council's decision, <br />Manager explained the procedure of asking staff recommendation on such questions as <br />policing problems, traffic, code compliance, etc., before an application is brought <br />for Council consideration. In addition, criteria on which the OLCC bases its <br />decisions is available to the Council - acceptable bonding, financial backing to avoid <br />any connection with liquor distributors, personal record, etc. Local criteria <br />takes into account character of surrounding land development, whether disturbing at <br />night to residential uses; proximity to public schools, churches, parks; compatability <br />with commercial uses; density of population; etc. <br /> <br />Councilman Hamel said he had viewed the property and noted parking requirements <br />were met. He felt the Council should not judge what had already been investigated, <br />and in view of the evidence he felt the application should be recommended for <br />approval. Councilwoman Shirey agreed, although she thought it unfortunate that <br />the zoning would allow this type of situation. <br /> <br />Vote was taken on the motion to recommend approval. The motion carried, all <br />Council members present voting aye, except Councilman Bradley abstaining. <br /> <br />Manager referred to a statement made about some city employe trying to arouse <br />opposition to the license. He explained probable confusion about investigation <br />made by OLCC; the city would not be calling on neighbors. Manager said several <br />people in the manager's office had talked recently with Mrs. Hall, an elderly <br />property owner in the area who was understandably upset about this license.
