Motion carried unanimously. <br /> <br />Council Bill No. 744 - Levying assessments for sanitary sewer to serve Tax Lots <br />500, 600, 700, and 800 off 30th, Avenue near Agate Street <br />(74-50) was read by council bill number and title only, there being no council member <br />present requestin that it be read in full. <br /> <br />Mr. Keller moved seconded by Mr. Williams that the bill be referred to Panel for hearing <br />on March 3, 1975 and brought back for Council consideration of Panel recommendations on <br />March 10, 1975. Motion carried unanimously. <br /> <br />v - Resolutions <br /> <br />Resolution No~ 2372 - Authorizing negotiations on Gillespie property east and west <br />of Gilham Road south of Ayres Road for park purposes was <br />read by number and title only. <br /> <br />Mr. Keller moved seconded by Mr. Williams to adopt the resolution. Rollcall vote. Motion <br />carried, Council members Murray, Keller, Williams, Hamel, and Haws voting aye; Council <br />members Bradley and Shirey voting no; Councilwoman Beal not present. <br /> <br />Mr. Hamel moved seconded by Mrs. Shirey that if staff is not able to make <br />satisfactory negotiations for purchase of the Gillespie property within <br />a reasonable period of time, the item be brought back to the Council for <br />possible dismissal. <br /> <br />Councilman Williams asked for clarification - whether the item was to be brought back <br />for further consideration or for dismissal. Mr. Hamel explained that his intent was that <br />if the staff was unable to negotiate the sale, if the property owner would not sell, <br />condemnation proceedings would be cancelled. Stan Long, assistant city attorney, ex- <br />plained that the resolution just adopted was final - that it authorized condemnation. <br />He recommended that if the Council wanted to consider the matter again prior to start <br />of condemnation the motion should simply instruct staff to notify Council before a con- <br />demnation suit was filed and at that time the Council would have the opportunity to repeal <br />the condemnation authorization. <br /> <br />City Attorney's recommendation was acceptable to both Council members Hamel <br />and Shirey and it was understood the motion was to instruct staff to return <br />to Council with the question of acquiring the Gillespie property prior to <br />start of any condemnation proceedings if negotiations were unsuccessful. <br />Motion carried unanimously, Councilwoman Beal not present. <br /> <br />Resolution No. 2373 - Authorizing negotiations on property for Barger Drive right- <br />of way was read by number and title only. <br /> <br />Mr. Keller moved seconded by Mr. Williams to adopt the resolution.
