Underground storm sewer in proposed Briarwood Mob,i Ie Home Estates <br />(south of Barger Drive, west of Danebo Avenue, north of Candlelight) <br />peti tioned by oWl~ers of 100% of property to be assessed. Ci ty cost <br />estimated at $30,480. <br /> <br />Mr. Keller moved seconded by Mr. williams to accept the <br />petition. <br /> <br />Councilman Bradley raised the question of litigation with which <br />Briarwood Estates is now involved. He wo~dered if acceptance of <br />the petition would result in the city's incurring costs that might <br />be rendered moot by the outcome of the lawsuit. Assistant Manager <br />said the engineering work would not be lost, that the project was <br />to provide underground drainage now carried in an open ditch at that <br />location. <br /> <br />It <br /> <br />Councilman Haws wondered if that storm drain would be constructed if <br />the Briarwood property was not developed, if there was possibility <br />of its remaining open land and used for park purposes. Don Gilman, <br />assistant public works director, said probably not, thut the open <br />ditch could probably remain if the land was not developed. He added <br />that under city policy the developer would pay for the equivalent of <br />a 24-inch pipe if the ditch was enclosed, the city paying for any- <br />thing over 24 inches on the theory that the additional size would <br />take care of area-wide drainage. <br /> <br />Further discussi~n resulted in consensus that the petition could be <br />accepted with the stipulation that no engineering work would start <br />until the Briarwood litigation was out of the way. <br /> <br />Councilmen Bradley and Haws stated their intent to abstain from voting <br />because of involvement in earlier stages of the Briarwood program. ' <br /> <br />Vote was taken on the motion to accept the petition with <br />the stipulation. that no engineering work would commence <br />until outcome of litigation with which the Briarwood Estates <br />was involved was known. Petition, Paving Spring Boulevard from North Shasta Loop to 500 feet <br />southeast of North Shasta Loop (Kandeda Subdivision) <br />Petitioned by owners of 47.3% of property to be assessed with estimated <br />deferred assessment for land not in the subdivision of $1,860. The amount <br />deferred represents the difference between assessment for 36-foot and that <br />for 28-foot width ror one-half of the improvement, and will be the responsi- <br />bility of the owner of the property on the north side of the street when <br />that land is developed. <br /> <br />- <br /> <br />Mr. Keller moved seconded by Mr. Williams to accept the petition. <br /> <br />\15 <br /> <br />4/14/75 - 23 <br />
