Vacancy, County Health Advisory Committee - Copies of letter from <br />~ne County were distributed to Council members advising of vacancy <br />on this commi ttee and invi ting recommendations for filling it. <br /> <br />Councilwoman Bea1 asked what qua1ificiations were required. Assistant <br />Manager read from the letter that the posi tion was earmarked for .a.,. . <br />"representative associated with higher education." counCi1membtf.5,~~~' <br />could check individually with.Lane County if they wished, since the <br />Commissioners make the appointment. He added that staff would forward <br />to the County for consideration any names subm1tted by next Wednesday, <br />April 23. <br /> <br />x. ./lppointment of Gary Long as a member of the NPELRA, a national board <br />pealing in labor relations, was announced. <br /> <br />Y.. ~nternational Arboretum Association request for $300 from room tax <br />funds for Arbor Day program. Sherm Flogstad, finance director, ex- <br />plained that the Room Tax Allocation Committee had denied the request <br />because of lim1ted amount of funds available - $84,000 for allocation <br />purposes for contractual services and more than $100,000 in applications <br />"tor contractual services. Also, of the two proposals presented by the <br />./lrboretum Association, the irrigation project for which $700 was <br />f'lllocated appeared to be of more long-range benefit to the community. <br />That project was one that would continue wi thout further ci ty par- <br />f;icipation. In response to Councilman Keller, Mr. F10gstad said the <br />$300 was requested to rent tables for display purposes for the Arbor <br />/)ay program, and the Allocation Committee felt things of that nature <br />could be provided through more participation of the Arboretum Associa- <br />tion memberShip. <br /> <br />Z. . yalleyRiver Trespass Case, Municipal. Court - Councilman Haws questioned the <br />city's becoming involved in labor disputes as seemed the situation from an <br />~rticle in theWillamette Observer concerning an employe/employer dispute at <br />Valley River Center. Mr. Haws quoted the article as it related to conlfict <br />pf interest - Valley River attorney assisting city prosecutor. Assuming the <br />quotations in the article were correct, he said, even the judge had reserva- <br />tions about what happened. <br /> <br />Issistant Manager explained that the action involved a trespass charge filed in <br />~nicipal. court. The city attorney determined prosecution was proper because <br />Qf code violation an4 that the complainant should and could assist in prepara- <br />rion of the case. That type of assistance is 9ommon practice, he said, in <br />frosecuting.tres~ss actions. <br /> <br />Councilman .l{ellerentered the;met:;ting. <br /> <br />~tan Long, .assistant city attorney, said the case had been appealed to .circuit <br />~urt after jury conviction 50, discussion at this point was not appropriate. <br />lfe suggested that inference which may have been drawn from the Observer .article <br />was not consistent wi th evidence presented by the ci ty. One of the. issues ~ <br />;f.nvolved was whether there was a labor dispute. He added that the complainant <br />Was a corporation acting through its attorney, and after the decision was made <br />~o prosecute, an offer of assistance from the complainant was accepted. In <br />/fr. Long's judgment, that did not constitute a conflict of interest.. With re- <br />iard to the judge's comments quoted in the article, Assistant.
