<br />Councilman Murray asked for present and projected population figures in the area <br />, generally south of 34th Avenue, cpmmenting that it might be pertinent to have data <br />also on purchasing power because of the probability of its being disproportionate <br />to pure population numbers. Staff indicated that data could be developed for the iIt <br />Council. <br /> <br />Mr. Murray inquired about other existing commercial areas south of 34th and whether <br />the city had explored other commercial sites south of 36th. Mr. Saul named small <br />commercial sites, excluding 30th and Hilyard, located at West Amazon and Larch (C-1), <br />East Amazon north of Larch (C-l), and Fox Hollow and Donald (C-2). He added that <br />there had been no consideration of other commercial areas east of Friendly and south <br />of 36th, only in the southwest portion of the city in the Lorane and Bailey Hill areas. <br /> <br />Mr. Murray asked about the process for rezoning the 40th and Donald area to C-l <br />should that be decided the thing to do. Also, how it would be decided if Bi-Mart <br />was allowable - who would decide? Mr. Saul answered that the building official <br />would be resonsible for that decision, with appeal privileges by either the pro- <br />ponents or opponents to the Zoning Code Board of Appeals and to the Council. <br /> <br />In response to Mr. Murray's inquiry about how extensive and where in the community <br />there are other properties zoned C-2 similar to the subject center, Mr. Saul sug- <br />gested a more detailed response could probably be given in written form. However, <br />he cited the Valu-Mart site on River Road as an example where the present use could <br />be debated as to whether it is C-l or C-2 (Fred Meyer catalog store). Also, the <br />30th and Hilyard center includes a number of uses that would not be permitted in a <br />C-l zone, and some that would be questionable uses in C-l. He added the general <br />area north and south of Franklin in the Garden Avenue area where a number of busi- <br />nesses would be nonconforming uses in terms of the Plan diagram. <br /> <br />Mr. Murray asked if site review procedure could be an option for handling the 40th <br />and Donald area regardless of the Council's decision on the zoning issue. Mr. Saul <br />answered that the Council did have the prerogative of attaching site review procedures, <br />however, it would not seem appropriate in view of the advanced development of the <br />property. It would serve little purpose in this instance, he said, where modifica- <br />tion of the existing building was about all that was proposed. He agreed with <br />Mr. Murray's assessment that if the decision was made to allow Bi-Mart at 40th and <br />Donald and site review procedure was attached, it would be reasonable to assume that <br />there would be a significant, noteworthy change in the current use of that facility. <br />Mr. Saul added that the site review provisions, however, would be fairly well pre- <br />scribed by the development already there. <br /> <br />-- <br /> <br />Councilman Bradley asked whether the Council had the authority to determine whether <br />Bi-Mart was a C-l or C-2 use under the building code, and whether either use was con- <br />sistent with the General Plan. Mr. Spickerman answered that his immediate reaction <br />would be that if the Council felt the Bi-Mart use was in keeping with the General <br />Plan, it could direct issuance of a building permit. As to whether it constituted <br />a C-l or C-2 use, he said, he was not sure of the implications and preferred answer- <br />ing in written form after some review. He said the questions raised were basic and <br />that action would better be delayed until a detailed response could be prepared. <br /> <br />Councilman Keller wondered if traffic projections could be developed taking into <br />consideration statistics quoted with regard to Bi-Mart trade area. Al Williams, <br />traffic engineer, said that in an objective way traffic statistics could be developed <br />showing projected use on 40th both east and west and overlaid on existing traffic ~ <br />patterns. He said, however, that it should be understood the results would not be ~ <br />a finite answer although there would be some degree of reliability. If the Council <br />understood that such a study would be subjective in nature, he said, that type of <br />data could be provided. <br /> <br />1/13/76 - 4 <br /> <br />2.$ <br />
