Staff recommendation for <br /> denial was based on legal grounds that the activity for which the funds were proposed <br /> does not involve services, rather they are to be used for planning and feasibility <br /> studies. He suggested placing the item on the October 27 committee agenda for fur- <br /> ther discussion with notification to applicants of such action. <br /> Mr. Keller moved second by Mr. Haws to refer the Theatre Project <br /> application back to the October 27, 1976 committee-of-the-whole <br /> meeting for further discussion. <br /> Councilman Murray questioned the reason for taking the application back to committee. <br /> He reierred to funds allocated to the Auditorium Association which were used for <br /> planning and feasibility studies. Stan Long, assistant city attorney, said there <br /> was some real question about whether the applicant had proposed something specific <br /> which under contract could be purchased that would be of public benefit. In staff's <br /> judgment, he said, the application did not fit those guidelines. Manager added <br /> that through discussion at the October 27 committee meeting, other answers could <br />e be given and a decision made then. <br /> Vote was taken on the motion as stated. Motion carried, all Council <br /> members present voting aye, except Councilman Haws and Bradley abstaining. <br /> 6.
