The Planning Commission had recommended approval on <br />January 4, 1977. <br /> <br />Councilman Haws asked if this was at the request of the property <br />owner, to which Manager replied yes. Mr. Williams requested <br />staff recommendations prior to the public hearing. Mr. Saul <br />indicated a package would be prepared by the Planning Department <br />and be distributed prior to the public hearing. He said the <br />provision for open space assessment is found in the State Statutes <br />and it relates~to the manner in which the land is assessed. <br /> <br />Mrs. Smith moved, seconded by Mr. Williams, to schedule <br />a public hearing for February 14, 1977. Motion carried <br />unanimously. <br /> <br />V. Review of Legislative Subcommittee actions. Re: State Legislative <br />Matters <br />Minutes of the Legislative Committee distributed to Council. Mr. <br />Williams, as acting chairman of the Legislative Subcommittee, <br />indicated there was only one area of disagreement in Senate Bill <br />2--relating to the Juvenile Code. He said it concerned whether <br />or not it should be within the purview of local officials to appre- <br />hend and detain out-of-state runaways. The Legislative Subcommittee's <br />recommendation was that local officials be authorized to do so; if <br />not, he indicated there would be a problem of 12 to IS-year old <br />runaways in the community who are unemployed, necessitating them to <br />commit crimes to survive, for instance prostitution and thievery. <br />Chief pierce Brooks, of the Police Department, said the major <br />concern of the Police Department was defining "serious conflict" in <br />Sect ion S and the inc Ius ion of "runaway" in Sect ion 17.
