<br />Mr. Haws moved, seconded by Mr. Hamel, that council bill 1360 be <br />approved and given final passage. <br /> <br />Mr. Delay moved, seconded by Mr. Bradley, to amend the motion <br />to rezone the 120 + acres to the M-1 PD Limited Industrial <br />District and drop the 260 + acres for single-family residential <br />use and the C-1 PD neighborhood commercial district for 10 ~ <br />acres. <br /> <br />. <br /> <br />Mr. Lieual1en said that to agree with that motion would imply there, <br />was no need for housing development in the area. Mr. Obie asked for a <br />point of order and said that that was not germane to the motion. Mr. <br />Bradley did not agree with Mr. Obie. His concern was procedural and <br />wondered if, by making such an amendment to the motion, it would be <br />opening the item for rebuttal by the proponents of the request as it <br />would be construed as new information. <br /> <br />Ms. Benjamin, City Attorney, noted that if there were any ex parte <br />contacts they should be stated now. There were none. She noted <br />Council could ask questions for clarification of the matter, but that <br />no area of interest could be opened up where a rebuttal would be <br />required. Mr. Delay felt this was a reasonable approach in that it <br />would accomplish t~ . primary concern of annexing the area <br />where a need had been established, but he was not convinced that there <br />was a need for the housing and commercial developments in that area. <br /> <br />Vote was taken on the amendment to the motion which did not <br />pass, with Delay and Bradley voting aye, and all other <br />Council members voting no. <br /> <br />e <br /> <br />Rollcall vote was taken on the original motion which passed <br />with all Council members present voting aye except Mr. Bradley <br />voting no, and council bill was declared passed and numbered <br />17901. <br /> <br />IV-A-4 <br /> <br />C. Amend City Code re: Library <br />Manager noted that this ordinance was necessary to amend the city <br />code in regard to the library to bring it into conformance with <br />the new charter which goes into effect April 1, 1977. <br /> <br />C.B. 1399--Amending City Code re: City Library; amending Sections <br />2.290 and 2.295 and adding Section 2.293; and declaring <br />an emergency was read by council bill number and title <br />only, there being no Council member present requesting <br />that it be read in full. <br /> <br />- <br /> <br />~8 <br /> <br />3/14/77 - 42 <br />
