Manager <br />noted the decision to consider the mixed-use district had evolved from <br />several hearings at the Planning Commission level. He said it was <br />the consensus of the Planning Commission that there was potential for <br />reconciling a series of difficult decisions in zoning a particular area by <br />having a mixed-use district zone available. Mr. Lieuallen said the <br />particular issue had come before Council previously and he had followed <br />the status of the westside neighborhood rezoning process through the <br />minutes of the Planning Commission, noting that those minutes were avail- <br />able to the City Council as well. Mr. Bradley felt the process perhaps <br />might be in error. Mr. Chenkin replied that it was not his evaluation that <br />the process was wrong. He said the Planning Commission felt it was taking <br />charge of its duties in making a more advantageous zoning use to bring the <br />Westside neighborhood area, in particular, into more conformity with the <br />Blayney Study objectives. He said the Mixed-Use District would be more <br />appropriate. Mr. Lieuallen noted the idea had not come all of the sudden, <br />but had been coming for a long time and he had been following the process. <br />He noted that Mr. Bradley could check through the past minutes of the <br />Planning Commission to see how the process had evolved. <br /> <br />_ II-A-3 <br /> <br />Vote was taken on the motion which passed, with all Council members <br />present voting aye except Mr. Bradley voting no. <br /> <br />Mr. Long of the City Attorney's Office noted there was an emergency <br />clause to the ordinance, and that the Council did not have a two-thirds <br />vote to enact that emergency clause, so this ordinance would take <br />effect in 30 days. <br /> <br />Council Bill 1427--Calling public hearing May 9, 1977 for easement <br />vacation located south of intersection of Fox Hollow Road and Dillard <br />Road (Entec, Inc.,) (EV 76-9) was read by council bill number and title <br />only, there being no Council member present requesting that it be read <br />in full. <br /> <br />Mr. Hamel moved, seconded by Ms. Smith, that Council Bill 1427 <br />be read the second time by council bill number only, with <br />unanimous consent of the Council, and that enactment be con- <br />sidered at this time. Motion carried unanimously and the bill <br />was read by council bill number only. <br /> <br />Mr. Hamel moved, seconded by Ms. Smith, that Council Bill 1427 <br />be approved and given fi nal passage. Roll call vote.
