<br />. <br /> <br />Mr. Haws moved, seconded by Mr. Hamel, that findings supporting <br />the rezoning as set out in Planning Commission Staff Notes and <br />minutes of April 5, 1977, be adopted by reference thereto; that <br />the bill be read the second time by council bill number only, <br />with unanimous consent of the Council; and that enactment be <br />considered at this time. Motion carried unanimously and the <br />bill was read the second time by council bill number only. <br /> <br />Mr. Haws moved, seconded by Mr. Hamel, that the bill be approved <br />and given final passage. Roll call vote. All Council members <br />present voting aye, the bill was declared passed and numbered <br />17985. <br /> <br />I-A-8 <br /> <br />E. Appeal of zone change denial: Located southwest of corner of 18th <br />Avenue East and Oak Street, from RP to C-2 (Sipe) (Z 77-7) <br /> <br />Manager reported that recommended denial had been unanimously voted <br />6-0 by the Planning Commission at its March 1, 1977 meeting. Jim <br />Saul, Planning Department, said the property contains about 21,000 <br />square feet and is presently occupied by an office structure, with <br />the purpose of the rezoning to allow addition of another wing to the <br />office structure. He said that for a number of years the Planning <br />Commission had tried to establish a buffer strip between the core <br />business district and residences to the south, with the RP strip along <br />18th Avenue established in 1948. The Planning Commission felt the <br />request was contrary to the recommendations of the 1990 General Plan, <br />which indicates that medium-high density residential use would be <br />appropriate for this area. Also, the zone change requests contra- <br />dicts the Planning Commission policy of encouraging high-density <br />residential use around the core area rather than continued commercial <br />expansion. Introduction of commercial zoning at this location would <br />have a serious impact on the residential area to the south. There <br />was no public need shown for a change of zone at this time. <br /> <br />No ex parte contacts or conflicts of interest were declared <br />by Council members. Planning Commission Staff Notes and <br />minutes of March 1, 1977, were received as part of the record <br />by reference thereto. <br /> <br />e <br /> <br />Public hearing was opened. <br /> <br />Ted Sipe, 2000 West 24th Street, said he was asking a rezoning on <br />only one lot, with the middle lot rezoned to C-2. He noted the <br />area would still have the RP buffer zoning, and he was available <br />to answer questions. <br /> <br />Public hearing was closed, there being no further testimony <br />presented. <br /> <br />Mr. Saul replied that Mr. Sipe was requesting action for a zone <br />change on property that did not correspond with what had gone before <br />the Planning Commission, and he was not sure what Mr. Sipe was <br />referring to, as there were two lots involved. <br /> <br />. <br /> <br />5/9/77--7 <br /> <br />3b~ <br />
