Appeal of zone change request denied by Planning Commission, property <br />located on south side of West 10th Avenue between Grant and Hayes <br />streets from RA to C-2 (Brewer) (Z 78-35) <br /> <br />Appeal was unanimously denied by Planning Commission December 12, 1978. <br /> <br />Mr. Saul said the property in question, owned by Mr. Brewer, is a <br />10,OOO-square foot parcel located on the south side of 10th Avenue. <br />A 9,OOO-square foot commercial structure, known as "West End Auction <br />Martll is on the parcel. This area was annexed to the city in 1944; <br />RA zoning was established in 1948. The commercial zoning antedates <br />the annexation to the city of Eugene. When the present zoning ordi- <br />nance was adopted in 1968, the West End Auction Mart was classified <br />as a non-conforming use, and a notice that stated that status was <br />provided to the owners of the property. In 1969, the Planning Com- <br />mission conducted a hearing for the purpose of establishing an amor- <br />tization period on this nonconforming use. It tabled action at that <br />time, pending a more detailed review of the neighborhood. The Plan- ~ <br />ning Commission has not yet taken that off the table. The present ~ <br />request was for allowing conversion of the West End Auction Mart to a <br />furniture store. The Planning Commission denied the zone change <br />because: 1) lack of need of commercial zoning in this area; 2) effort <br />of the City to establish residential neighborhoods in this area; and <br />3) location of the park directly across from the property. <br /> <br />No ex parte contacts or conflicts of interest were declared <br />by the Councilors. <br /> <br />Staff notes and minutes were entered into the record. <br /> <br />Public hearing was opened. <br /> <br />Mike Farthing, 975 Oak Street, attorney representing Mr. Brewer, <br />noted that the applicant owns 1900 West 11th, making the frontage <br />a little bit larger than noted on the Planning Commission map. <br />Mr. Farthing said the property was already an existing commercial use; <br />that it had a commercial building on it; and that no residential <br />buildings would be removed. Medium-density residential would require <br />destruction of the building; therefore, it would not be economical. <br />It would not be compatible with the commercial property surrounding <br />this property.
