<br />e <br /> <br />e <br /> <br />- <br /> <br />Ms. Miller moved, seconded by Mr. Obie, to appoint the indi- <br />viduals named in the February 4, 1981, memo to the Aging, <br />Handicapped, Minority, and Youth commisions, and to appoint <br />the individuals named in the February 11, 1981, memo to the <br />Women's Commission. <br /> <br />Roll call vote; motion carried unanimously. <br /> <br />II. ROUTINE ITEMS FOR COUNCIL APPROVAL <br /> <br />A. Approval of Council Minutes of December 22, 1980 <br /> <br />Ms. Miller moved, seconded by Mr. Obie, to approve the council <br />minutes of December 22, 1980. Roll call vote; motion carried <br />unanimously. <br /> <br />III. CETA PROGRAM <br /> <br />Mr. Gleason stated that a staff presentation would be given on the problems <br />involving the CETA program and the proposed change from a "contract" to "agent" <br />relationship. He introduced Gary Long, Staff Services Director. <br /> <br />Mr. Long stated that last Tuesday an opinion from the Attorney General was <br />received and it has been reviewed. City, State, and County governments have <br />a problem regarding Prime Sponsor liability and the constitutionality of our <br />current program. Structural and legal alternatives might be options. The CETA <br />program in Eugene this year represents $4.0 million. It will serve a thousand <br />City residents and the preference is to look for alternatives rather than to <br />stop the program. Stan Long, City Attorney, has suggested modifying the current <br />contract relationship and creating an agent relationship for a period of approx- <br />imately 30-60 days. However, this would create additional tort liability. That <br />seems to be acceptable for a short term. On a long-term basis, the Department <br />of Labor regulations need to be changed, but this will require legislation. <br /> <br />Ms. Smith encouraged the council to follow the staff recommendations and follow <br />up with communication with the Congressional delegation. <br /> <br />Ms. Wooten stated that Congressman Weaver's office has received inquiries <br />and he also is working on this problem. They will submit a letter signed <br />by the entire delegation to the Department of Labor on the 26th or 27th. Other <br />states are similarly affected, so it should not be too difficult to change the <br />regulations fairly rapidly. Mr. Lindberg agreed that it would be insensitive <br />to drop the program over legal technicalities. He asked for clarification of <br />the agent relationship. The City Attorney, Mr. Long, stated that the change in <br />operation would involve changing the employer1s subcontractor status from <br />individual contractors to agents of the City. The City would take on the <br />liability of the agents and be responsible for their action. This should be <br />done for only a short period.
