AttachmentA <br />RESOLUTION NO. 5222 <br />A RESOLUTION TO SUPPORT THE ESTABLISHMENT OF THE <br />EUGENE ERUV. <br />The City Council of the City of Eugene finds that: <br />A. <br /> In accordance with the Jewish religion, the laws of the Sabbath contain the <br />commandment “Let no person go out from their place on the Sabbath day.” In the Jewish religion, <br />a person’s “place” is defined by specifying certain natural or artificial boundaries and, by mutual <br />agreement, leasing the use of the common domain. <br />B <br />. An eruv is a virtual, symbolic demarcation of boundaries surrounding a public area <br />or neighborhood within which people of the traditional Jewish faith may carry objects and push <br />baby strollers on the Sabbath day. According to Jewish law, an eruv requires the approval of the <br />city to use the space for such a function. Officially, the community needs to “rent the rights to the <br />public domain for the purpose of carrying on the Sabbath and other Jewish holy days.” <br />C. <br /> The Eugene Eruv Committee, led by Rabbi Jacob Siegel on behalf of those of <br />Jewish faith who reside in South Eugene, request the creation of the Eugene Eruv. The Eugene <br />Eruv will be roughly bounded by the South Hills on the south and east, the riverbank on the north, <br />and Polk/Monroe streets on the west. This land will be rented for a period of ninety-nine years, at <br />a rental of one dollar, the rights to the public domain within the aforementioned area for the <br />purpose of “carrying” on the Sabbath and other Jewish holy days. The erection of the Eugene <br />Eruv will in no way affect the rights of any individual living or otherwise present within its borders. <br />D. <br />The City of Eugene has a history of, and a commitment to, religious freedom and <br />the City Council has adopted Ordinances and Resolutions that demonstrate this commitment, <br />including: <br />1.Human Rights Municipal Code provisions, EC 4.613 - 4.655 (adopted in <br />1971, with the most recent amendment adopted in 2014 which made it unlawful to <br />discriminate based on gender (Ord. 20523)) <br />2.Resolution 5174 (adopted in 2016) A Resolution Declaring the City of <br />Eugene’s Commitment to Being a Welcoming, Inclusive, and Safe Community for <br />Everyone <br />E. <br />We believe in, and are committed to, continuing our work to build a community <br />where people freely follow their religious and spiritual conscience and that is welcoming and <br />inclusive for everyone. <br />NOW, THEREFORE, <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EUGENE, a <br />Municipal Corporation of the State of Oregon, as follows: <br />Section 1 <br />. The City of Eugene grants the rights requested by the Eugene Eruv Committee <br />to allow those of the Jewish faith to freely exercise their religious obligations for a period of ninety- <br />Resolution - Page 1 of 2 <br /> <br />
