ATTACHMENT A <br />ORDINANCE NO. ________ <br />AN ORDINANCE CONCERNING THE PROHIBITION OFUNLICENSED DOGS <br />WITHIN THE DOWNTOWN COREAND AMENDING SECTION4.427 OF THE <br />EUGENE CODE, 1971. <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br />Section 1. <br />Subsection(3) of Section 4.427 of the Eugene Code, 1971, isaddedto provide <br />as follows: <br />4.427Dogs -Certain Areas Prohibited <br />. <br />(1) <br />Except as provided in subsection (2) of this section, no dog owner shall permit <br />a dog to be on Alder Street, including the sidewalks thereof, between and <br />including the southern sidewalk of East 12th Avenue and the northern <br />sidewalk of East 14th Avenue, noron East 13th Avenue, including the <br />sidewalks thereof, between and including the eastern sidewalk of Pearl Street <br />and the eastern sidewalk of Kincaid Street. <br />(2) <br />The prohibition of subsection (1) of this section does not apply to a dog owner <br />who maintains a lawful residence within the restricted area, to a dog assisting <br />law enforcement personnel, to a dog assisting an individual with a disability, or <br />to a dog inside a motorized vehicle. <br />(3)Unless the dog owner holds a valid dog licensethat certifies the dog has <br />been vaccinated for rabiesand the license is attached to a collar or <br />harness on the dog for which it is issued, nodog owner shall permit a <br />dog to be within the downtown coreas that areais defined in section <br />4.871 of this code, except for the publicly owned property and rights-of- <br />th <br />way abutting the Dining Room located at 270 W 8Avenue. <br />Section 2. <br />Pursuant to the provisions of Section 32(2) of the Eugene Charter of 2002, with <br />the affirmative vote of two-thirds of the members of the City Council, this Ordinance shall become <br />effective immediately upon adoption by the Council and approval by the Mayor, or passage over <br />the Mayor’s veto.
