The applicant does not believe that a TIA <br />is necessary due to the clear policy direction of the Eugene Downtown <br />Plan for redesignation and rezoning of this site. Even if specific <br />findings on Goal 12 are necessary, positive findings can be made on <br />Goal 12 without aTIA. <br /> <br />Besides the issue of the unnecessary expense of a TIA, we have not <br />capitulated to the staffs request in order to determine if the Eugene <br />Downtown Plan is going to be implemented' in a manner consistent <br />with the intent expressed at the time of the Downtown Plan's adoption <br />that it be a working and effective document to facilitate development in <br />the downtown area. <br /> <br />A. The Eugene Downtown Plan policy directs the redesignation <br />and rezoning of this parcel. <br /> <br />The applicable refinement plan is the Eugene Downtown Plan, adopted <br />April 12, 2004. ~n adopting that plan, the City Council did not alter <br />the Metro Plan Diagram. In a separate ordinance, the City Council <br />placed the Nodal Development overlay on the Downtown Plan area and <br />changed the land use designation of the Courthouse District from <br />Industrial to Commercial designation.
