Planning & Development <br /> Planning <br /> <br /> City of Eugene <br /> 99 West 10th Avenue <br />MEMORANDUM <br /> (541) 682-5377 <br /> (541) 682-5572 FAX <br /> www. ci.eugene.or, us <br /> <br />Date: June 20, 2005 <br />To: Mayor Piercy and City Council <br /> <br />From: Neil Bj6rklund, 682-5507 <br /> Senior Planner <br /> <br />Subject: Goal 5 and Habitat in the South Hills <br /> <br />Introduction <br /> <br />On June 8, 2005, the Council approved the following motion: <br /> <br /> Council Motion: Ms. Taylor, seconded by Mr. Kelly, moved to direct the City Manager to review <br /> and update the Goal 5 wildlife habitat inventory for the south hills, using the safe harbor <br /> inventory methodology in OAR 660-023-0110 in light of new information concerning the <br /> presence of the sensitive species Pileated Woodpecker in substantial areas of the south hills. <br /> <br /> The vote on the motion was a 4:4 tie; Ms. Taylor, Mr. Kelly, Ms. Bettman, and Ms. Ortiz voting <br /> yes; Mr. Papd, Mr. Poling, Ms. Solomon, and Mr. Pryor voting no; Mayor Piercy cast a vote in <br /> support of the motion and it passed on a final vote of 5:4. <br /> <br />This memo discusses the technical and process issues related to this motion. <br /> <br />The June 8, 2005 Council motion related to Eugene's Goal 5 inventory refers to the adoption of the <br />riparian and upland wildlife habitat inventories by the Eugene City Council in July 2003. The Eugene <br />Planning Commission had recommended that the Council adopt the entire preliminary inventory, <br />applying the %tandard" inventory process to all sites, including large areas of the South Hills. The <br />standard process involves applying locally adopted significance criteria to determine which mapped <br />resource sites will be further studied and considered for protection. The %afe harbor process" is a simpler, <br />alternative approach, in which the local jurisdiction includes on the inventory only the specifically listed <br />resources that are already mapped by state or federal agencies or by qualified professionals. At that time, <br />the Council voted to apply the Goal 5 %afe harbor" inventory process to the areas in the South Hills <br />outside of mapped stream corridors, and to apply the Goal 5 %tandard" inventory process to the <br />remainder of the inventory recommended by the Planning Commission. <br /> <br />Application of Goal 5 Safe Harbor Provisions in 2003 <br /> <br />During City Council work sessions on Goal 5 on May 28, 2003 and June 23 2003, members of the <br />Council raised the idea of using Goal 5 %afe harbor" provisions for the riparian and upland wildlife <br />habitat inventories. The Council discussed applying safe harbor inventory provisions to all sites, which <br />would have reduced the number of sites on the inventory, including riparian sites. The Council also <br />discussed a %plit" approach of applying standard process inventory provisions to waterways, and safe <br /> <br /> <br />
