<br />\"\ <br /> <br />\ <br />'I: <br /> <br />J especially OAR 660-023-0180(2)( c) and (7), that LCDC intended that its administrative rule <br />2 preempt all local regulations pertaining to the approval of aggregate mining. 16 According to <br />3 petitioners, LUBA has held that OAR 660-023-0180(7) does not permit a local government <br />4 to apply local code provisions to deny a post-acknowledgement plan amendment for mining. <br /> <br />5 See Morse Bros., Inc. v. Columbia County, 37 Or LUBA 85, 89 (1999), aff'd 165 Or App <br />6 512, 996 P2d 1023 (2000) ("* * * OAR 660-023-0180(7) has the legal effect of preempting <br /> <br />7 county comprehensive plan and land use regulation provisions that would otherwise apply to <br />8 a post-acknowledgement plan amendment * * *"). <br /> <br />"(i-i) necessary to correct an identified error in the application of the Plan; OR <br /> <br />"(ii-H) necessary to fulfill an identified public or community need for the intended <br />result of the component or amendment; OR <br /> <br />"(iii-iii) necessary to comply with the mandate of local, state or federal policy or <br />law; OR <br /> <br />(iv-iv) necessary to provide for the implementation of adopted Plan policy or <br />elements; OR <br /> <br />"(v-v) otherwise deemed by the [B]oard [of Commissioners], for reasons briefly <br />set forth in itS decision, to be desirable, appropriate or proper." <br /> <br />"* * * * * <br /> <br />LC 16.252(2) sets out the requirements for re~ning property. It provides, in relevant part that <br /> <br />"rezonings * * * shall be enacted to achieve the general purpose of this Chapter and shall not <br />be contrary to the public interest." <br /> <br />16 OAR 660-023-0 180(2)(c) provides, in relevant part: <br /> <br />"Local governments shall follow the requirements of [OAR 660-023-0180(4)] in deciding <br />whether to authorize the mining of a significant mineral or aggregate resource site[.]" <br /> <br />OAR 660-023-0180(7) provides, in relevant part: <br /> <br />"Local governments shall amend the comprehensive plan and land use regulations to include <br />procedures and requirements consistent with this rule for the consideration of PAPAs <br />concerning aggregate resources. Until such local regulations are adopted, the procedures and <br />requirements of this rule shall be directly applied to local government consideration of a <br />PAP A concerning mining authorization( .]" <br /> <br />Page 41 <br />
