<br />ECC <br />UGENE ITY OUNCIL <br />AIS <br />GENDA TEM UMMARY <br /> <br /> <br /> <br /> <br />Public Hearing: An Ordinance Concerning the Police Auditor and Civilian Review <br />Board; Amending Section 2.013 of the Eugene Code, 1971; Adding Sections 2.240, <br />2.242, 2.244, 2.246, 2.450, 2.452, 2.454 And 2.456 to that Code; and Providing an <br />Effective Date for Implementation (CB #4936) <br /> <br /> <br />Meeting Date: December 11, 2006 Agenda Item Number: 4 <br />Department: Police Auditor Staff Contact: Cristina Beamud <br />www.eugene-or.gov Contact Telephone Number: 682-5005 <br /> <br /> <br /> <br /> <br />ISSUE STATEMENT <br />This is a public hearing on the proposed ordinance to commence the provision of services to the public <br />by the Police Auditor and the Civilian Review Board. <br /> <br /> <br />BACKGROUND <br /> <br />The City Charter amendment passed in November 2005 (Measure 20-106) established the authority and <br />parameters of the work to be performed by the Auditor and the Civilian Review Board. An ordinance is <br />necessary in order to frame the scope of this authority and to describe general procedures for the <br />Auditor’s Office. The Police Commission presented a draft framework describing the authorities of the <br />Auditor’s Office and the Civilian Review Board in August 2006. The proposed concepts were drafted <br />with the assistance of the City Attorney. There was additional input by members of the Police <br />Commission in order to develop definitional terms for the proposed ordinance. The City Council held a <br />work session on November 13, 2006, to review the concepts and provisions of the proposed ordinance. <br /> <br />While the proposed ordinance outlines the general procedures and authority for the Auditor and the <br />Civilian Review Board, it is intended only to set broad parameters and allow for the development of <br />protocol that provides for more detailed procedural guidelines. It is designed to be flexible in order to <br />permit both the Auditor and the Civilian Review Board to exercise some discretion, but also set forth the <br />parameters of their authority as defined by the Charter. <br /> <br />The current language in the proposed ordinance was originally developed by the Police Commission in <br />collaboration with a broad range of stakeholders. It was reviewed by the Auditor and, subsequently <br />revisions were made to address and clarify authority and responsibility. The major components revised <br />by the Auditor include: <br /> <br />Providing for the Civilian Review Board to include either 5 or 7 members and establishing the length <br />? <br /> <br />of their terms of office. <br />The definition section of the proposed ordinance includes the two forms of alternative dispute <br />? <br /> <br />resolution that are frequently used in other civilian oversight models, since these are the only two <br /> L:\CMO\2006 Council Agendas\M061211\S0612114.doc <br />
