Also, please correct the database entry so that this application shows up on a search for Measure <br />49 Claim in the past year (On Advanced Search) lists this application. (My search returned "No <br />records were found matching the search parameters you entered") <br />I've review the cited code provision, which states: <br />9.2752(18)(a)3. Building Size. The total building square footage of a dwelling shall not <br />exceed 10 percent of the total lot area or 800 square feet, whichever is smaller. <br />On the face of it, this seems to be an erroneous requirement because a legal, full-size R-1 lot of <br />4,500 s.f., would allow a dwelling of only 45 s.f., which is not a reasonable size. In order for the <br />limit of 800 s.f., to go into effect, the alley access lot would have to be over 8,000 s.f., and I doubt <br />there are more than a few, if any alley access lots of that size.Further, the "Lot Coverage" standard <br />in sub (4) would be practically meaningless; and the "Bedrooms" limit would also be practically <br />meaningless. I would recommend you check the file on Ordinance 20541 to verify that (3) wasn't <br />supposed to state "whichever is greater." <br />Although a reasonable limit to the size of a dwelling on an alley access lot would not trigger a valid <br />M49 claim (see the City's most recent decision), a limit of 462 feet might be construed as being a <br />practical prohibition against creating any dwelling, and therefore would potentially merit approval <br />of a M49 claim. <br />In any case, the council could amend the code to make sense, by replacing "smaller" with "greater" <br />or increasing the 10% to a larger value (e.g., 15% or 20%).
