ORDINANCE NO. 20603 <br />AN ORDINANCE CONCERNING THE PROHIBITION OF SMOKING ON PUBLIC <br />RIGHT-OF-WAY ADJACENT TO OPTED -IN PROPERTIES; THE PROHIBITION <br />OF SMOKING WITHIN THE DOWNTOWN CORE AND ALLOWING FOR <br />PROPERTIES TO OPT -OUT; AND AMENDING SECTION 6.230 OF THE <br />EUGENE CODE, 1971. <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br />Section 1. Subsection (2) of Section 6.230 of the Eugene Code, 1971, is amended to add <br />a new subsection (q) and to provide as follows: <br />6.230 Smoking Prohibited in Public Places and Places of Employment. <br />(2) Smoking is prohibited on all real property owned by the city and in all public <br />places and all places of employment within the city, including, but not limited <br />to the following: <br />(q) If requested by the property owner and approved by the city manager, <br />public rights-of-way adjacent to properties where smoking is prohibited by <br />subsections (2)(a) -(p) of this section, and public rights-of-way adjacent to <br />smoke free publicly owned properties. The request shall comply with the <br />rules adopted by the city manager under section 2.019 of this code. <br />Section 2. Subsection (2) of Section 6.230 of the Eugene Code, 1971, is amended to add <br />a new subsection (r) and to provide as follows: <br />(2) Smoking is prohibited on all real property owned by the city and in all public <br />places and all places of employment within the city, including, but not limited <br />to the following: <br />(r) Within the downtown core as that area is defined in section 4.871 of this <br />code. Notwithstanding the prohibition contained in this section, the city <br />manager is authorized to permit smoking in designated areas adjacent to <br />private establishments that request such permission and that comply with <br />the rules adopted by the city manager under section 2.019 of this code. <br />Section 3. A map generally depicting the geographic boundary described in EC 6.230(2)(r) <br />is attached hereto as Exhibit A. <br />Ordinance - Page 1 of 2 <br />
