V. PUBLIC HEARING AND POSSIBLE ACTION: An Ordinance Granting to Williams <br /> Communications a Nonexclusive Franchise to Use the Public Way to Construct and <br /> Maintain Public Communication Facilities Within the City of Eugene <br /> <br />Mayor Torrey opened the public hearing. Seeing no one wishing to speak, he closed the public <br />hearing and called for council questions/comments. <br /> <br /> Councilor Pap~, seconded by Councilor Nathanson, moved that the City <br /> Council adopt Council Bill 4816, an ordinance granting to Williams <br /> Communication a non-exclusive franchise to use the public way to construct <br /> and maintain public communication facilities within the City of Eugene. Roll <br /> call vote; the motion passed unanimously, 7:0. <br /> <br />VI.PUBLIC HEARING AND POSSIBLE ACTION: An Ordinance Concerning Telecommuni- <br /> cations and Amending Section 3.415 of the Eugene Code, 1971, and Providing an <br /> Effective Date <br /> <br />Mayor Torrey opened the public hearing. Seeing no one wishing to speak, he closed the public <br />hearing and called for questions/comments from the council. <br /> <br />Seeing no opposition to taking action that evening, Mayor Torrey called for a motion from the <br />Council President. <br /> <br /> Councilor Pap~, seconded by Councilor Nathanson, moved that the City <br /> Council adopt Council Bill 4817, an ordinance concerning <br /> telecommunications and providing an immediate effective date. Roll call <br /> vote; the motion passed unanimously, 7:0. <br /> <br />VII.ACTION: An Ordinance Concerning a Business License Tax on Motor Vehicle Fuel <br /> Dealers, Providing for Administration, Enforcement and Collection of the Tax; Adding <br /> Sections 3.465, 3.466, 3.467, 3.468, 3.469, 3.470, 3.471, 3.472, 3.473, 3.474, 3.475, <br /> 3.476, 3.477, 3.478, 3.479, 3.480, 3.481, 3.482, 3.483, 3.484, 3.485, 3.486, 3.487, 3.488, <br /> and 3.489 to the Eugene Code, 1971 <br /> <br />Public Works Department Director Kurt Corey provided an introduction to the item. He said the <br />tax represented the second component of the comprehensive transportation funding <br />recommendation from the citizen members of the Budget Committee. He noted that the public <br />hearing for the item had been held on October 28, 2002. He said the ordinance would declare a <br />business license tax of $.04 per gallon on motor vehicle fuel dealers. He added that the tax would <br />be imposed on fuel distributers delivering fuel to the city to minimize the administrative burden on <br />individual fuel stations. <br /> <br />Mr. Corey said the ordinance had been drafted so as to be consistent with other Oregon cities and <br />counties that had implemented similar local option gas taxes and to be consistent with the Oregon <br /> <br /> MINUTES--Eugene City Council January 27, 2003 Page 10 <br /> Regular Meeting <br /> <br /> <br />
