24 • Officers A, B, and C were dispatched to a disorderly subject described as “violent and aggressive.” Officer C was the primary officer. Officer B contacted the suspect and the Reporting Party (RP). • Officer B later stated he was having trouble communicating with RP. Officer A arrived and also contacted RP. • RP later complained to the Auditor’s Office that Officer A repeatedly told him to “shut the f*** up” and that Officer A flipped him off when he left the scene. • The investigation showed that Officer A used profanity repeatedly during his conversation with the RP. • Officer A denied that he flipped off RP when leaving; in-car video (ICV) of the incident appeared to show him waving to a different group (but video quality was somewhat poor). Allegations: 1. 1101.1.B.7 Courtesy: That Officer A spoke to the RP in a discourteous and unprofessional manner, using profane and insolent language. 2. 1101.1.B.7 Courtesy: That Officer A used a profane and insolent gesture directed toward RP as he drove away from the scene of their contact. Courtesy • EPD chain of command: Unfounded • Auditor’s Office: Unfounded • Chief: Unfounded Issues for the CRB: CRB members agreed with the classification of the case as the officer had used profanity repeatedly with RP. A discussion of language as use of force ensued with some members believing it could be a useful tool and others feeling that its use at all was unprofessional. H. October Case Review Officer A and Officer B were dispatched to a call of a suspicious subject who had frightened the caller. Officer B contacted the person and was concerned by his responses to her questions. Officer B knew that Officer A was some distance away and did not try to detain the person.
