ADMINISTRATIVE ORDER NO. 53-18-13 <br />of the <br />Executive Director of Planning & Development Department <br />DELEGATING TO THE COMMUNITY DEVELOPMENT DIVISION <br />MANAGER OF THE PLANNING & DEVELOPMENT DEPARTMENT <br />THE AUTHORITY TO GRANT EXTENSIONS AND EXEMPTIONS OF <br />DOWNTOWN SERVICES DISTRICT OCCUPANCY FEES AND WEST <br />UNIVERSITY SERVICES DISTRICT OCCUPANCY FEES. <br />The Executive Director of the Planning & Development Department of the City of <br />Eugene finds that: <br />A. Under the provisions of Chapter IV, Section 16 of the Eugene Charter of 2002, the <br />City Manager is designated as the administrative head of the City, and is specifically authorized <br />to appoint and remove all employees (except as otherwise provided in the Charter), and to enforce <br />all ordinances of the City. <br />B. On July 2, 1996, the City Manager issued Administrative Order No. 53-96-09 <br />which, in part, delegated authority to the Executive Director of the Planning & Development <br />Department to perform the duties and responsibilities of the City Manager set forth in Chapter 3 <br />of the Eugene Code, 1971, and further authored that those duties may be sub -delegated to qualified <br />person(s). <br />C. To implement the provisions of Sections 3.650 to 3.680 of the Eugene Code, 1971, <br />on May 5, 1998, the City Manager issued Administrative Order Nos. 53-98-01-F establishing <br />Downtown Services District Occupancy Fee Administrative Rule R-3.655(1), and Administrative <br />Order No. 53-98-03-F establishing West University Services District Occupancy Fee <br />Administrative Rule R-3.655(2). <br />D. Rule R -3.655(1)-E and Rule R -3.655(2)-E set out provisions under which the City <br />Manager or designee can grant extensions to file occupancy fee reports, and grant occupancy fee <br />exemptions. I find that it would be more efficient and in the public interest to authorize the <br />Community Development Division Manager of the Planning & Development Department to <br />administer those sections of the Rules. <br />NOW, THEREFORE, <br />The Executive Director of the Planning & Development Department of the City of <br />Eugene Orders and Directs that: <br />1. The Community Development Division Manager of the Planning & Development <br />Department is authorized to grant Downtown Services District occupancy fee extensions and <br />exemptions pursuant to Rule R -3.655(1)-E and to grant West University Services District <br />occupancy fee extensions and exemptions pursuant to Rule R -3.655(2)-E. <br />Administrative Order - Page 1 of 2 <br />
