CLEAR & OBJECTIVE HOUSING: APPROVAL C RITERIA UPDATE <br />November 13, 2018 DRAFT Preferred Concepts Report: Maintenance Issues Page 5 of 59 <br />Maintenance Issues: Summary Table of Preferred Concepts <br />Several identified issues represent procedural changes or amendments that would create consistency between <br />the clear and objective and discretionary review tracks, consistency with other sections of the land use code, or <br />otherwise improve efficiency or effectiveness. They require only maintenance-level code revisions that are <br />relatively straightforward. These maintenance level issues were not addressed as part of the working group <br />sessions as they offer readily-available solutions that require less attention and discussion relative to the larger, <br />more challenging issues that were discussed by the working groups. <br />Maintenance Issue Preferred Concept Reason <br />COM-01 Needed Housing Criterion For conditional use, partition, planned unit <br />development, site review, and su bdivision applications , <br />remove criterion that requires applicant to demonstrate <br />that the proposed housing is needed housing . <br />Consistency with <br />State Law <br />COM-02 Applicable Standards <br />Reference for CUPs <br />For conditional use, revise the language to require <br />compliance with all applicable standards (instead of <br />using “including but not limited to”) and add additional <br />development standards to the list of standards, <br />including public improvement and street standards. <br />Consistency with <br />other clear and <br />objective <br />application types <br />COM-03 Bonding Requirement For conditional use permits and site reviews, revise the <br />timing specified to construct or bond for required public <br />improvements to be prior to issuance of a development <br />permit. <br />For final planned unit developments no t associated with <br />land divisions, add a criterion, similar to that required <br />for final subdivisions, to require that public <br />improvements be completed or bonded prior to <br />approval of the final application. <br />Effectiveness <br />COM-04 Overlay Zone Standards Revise the clear and objective track approval criteria for <br />the five application types to include compliance with the <br />lot dimensions and density requirements in overlay <br />zones. Use the same language provided for the <br />discretionary track applications to require compliance <br />with: “Lot standards of EC 9.2000 through 9.4170 <br />regarding applicable lot dimensions and density <br />requirements.” <br />Consistency with <br />discretionary track <br />COM-05 Planned Unit <br />Deve lopment <br />Adjustment/Modification <br />Replace criterion that requires compliance with “all <br />applicable development standards explicitly addressed <br />in the application except where the applicant has shown <br />that a modification is consistent with the purposes as set <br />out in EC 9.8300 Purpose of Planned Unit Development” <br />with a requirement for compliance with “all applicable <br />development standards explicitly addressed in the <br />application” and continue to allow for adjustment <br />reviews. <br />Efficiency, <br />Effectiveness <br />November 26, 2018, Work Session – Item 2
