CLEAR & OBJECTIVE HOUSING: APPROVAL C RITERIA UPDATE <br /> <br /> <br />November 13, 2018 DRAFT Preferred Concepts Report: Significant Issues Page 58 of 59 <br /> <br />COS-20 (P EDESTRIAN D EFINITION) <br />Description : There are many references in the land use code to the word “pedestrian .” However, the term is <br />not defined in the definitions section of the land use code at EC 9.0500. <br />Applies To : Conditional Use, Partition, Planned Unit Development, Site Review, Subdivision <br />Existing Code Section(s): Multiple <br />Existing Code Language : Below is one example: <br />9.8520 Subdivision, Tentative Plan Approval Criteria - Needed Housing <br /> (6) The proposed subdivision provides safe and adequate transportation systems through compliance with <br />the following: <br />(a) Provision of pedestrian, bicycle and transit circulation among buildings located within the <br />development site, as well as to adjacent and nearby residential areas, transit stops, <br />neighborhood activity centers, office parks, and industrial parks, provided the city makes findings <br />to demonstrate consistency with constitutional requirements. “Nearby” means uses within 1/4 <br />mile that can reasonably be expected to be used by pedestrians, and uses within 2 miles that can <br />reasonably be expected to be used by bicyclists. <br /> <br /> <br /> <br /> <br />Recommendation : Add definition for ‘pedestrian’ based on modified version of that provided in the Oregon <br />Revised Statutes (ORS). <br />There was strong stakeholder support for using the definition of pedestrian provided in State statutes at ORS <br />801.385[Oregon Vehicle Code]. This would provide clarity when the term pedestrian is used in the clear and <br />objective approval criteria. It was suggested that changing “confined to a wheelchair” to “using a wheel chair” <br />A. No Change o o + o o o <br />B. Define pedestrian as "non -motorized use(r)s of <br />transportation facilities, including, but not limited <br />to bicyclists, pedestrians, wheelchair users, child <br />strollers, and individuals who have sight, hearing <br />or mobility impairme nts or any other condition <br />that affects their safety when travelling on public <br />or private transportation facilities.” <br />oo–oo o <br />C.
