Councilor Bettman voiced her support for the amendment, calling the 50,000 square foot limit on clinic <br />space reasonable. <br /> <br />In response to a question from Councilor Pap6, Ms. Bishow related that the Planning Commission had <br />unanimously voted in support of removing the restriction to the size of clinic development. She said the <br />commission had looked at the context for the size limit and based its recommendation on the change in use <br />for the property across the street. The commission had looked at the TIA and had been assured that traffic <br />mitigation measures would be carried out should traffic warrant it. <br /> <br />Councilor Kelly felt the Crescent node would not be discemable from the rest of the city. <br /> <br /> The motion to amend the ordinance failed, 5:3; councilors Bettman, Taylor, and <br /> Kelly voting in favor. <br /> <br />Mayor Torrey asked if there would be opposition to addressing the issue at the present meeting. <br /> <br />Councilor Bettman asked if it would be possible to amend the ordinance to ensure that the development <br />would not get the discounts that the/ND overlay would provide. Mr. Lidz said it was conceivable to make <br />the change, but he would not be comfortable incorporating this into the Land Use Code. He suggested <br />researching the issue and bringing back information to the December 3 work session. He stressed that this <br />was an ;;SDC issue" and the ordinance under consideration did not pertain to SDCs. <br /> <br />Mayor Torrey stated that the council would address the issue at the coming work session during Item B of <br />the agenda. <br /> <br />5. PUBLIC HEARING: An Ordinance Requesting that Jurisdiction Over a Portion of <br /> County Road No. 307, 388, 531, and 1304 (Garden Way) be Transferred to the City of <br /> Eugene Within a Specified Period of Time <br /> <br />City Manager Taylor explained that the ordinance transferred jurisdiction over Garden Way from Lane <br />County to the City of Eugene. He said this was one of the last actions before going to bid on this project. <br />He stated that the engineering division was 90 percent completed with its portion of the project. <br /> <br />Mayor Torrey opened the public hearing. <br /> <br />Seeing no one wishing to testify, Mayor Torrey closed the public hearing. <br /> <br />Mayor Torrey opened the floor for questions and comments by the council. <br /> <br />Councilor Bettman questioned the wisdom of taking on more streets when the City did not have the <br />resources to maintain the existing transportation system. She asked what advantage this transfer provided <br />the City. <br /> <br />Paul Klope, Principal Civil Engineer for the Public Works Department, explained that, if left a County <br />street, the City could request a permit to build the street.
