ATTACHMENT D <br /> ORDINANCE NO. <br /> <br /> AN ORDINANCE CONCERNING OFFENSES; AMENDING SECTIONS <br /> 4.105, 4.807 AND 4.990 OF THE EUGENE CODE, 1971; ADDING <br /> SECTIONS 4.710, 4.728, 4.822, 4.880, 4.882 AND 4.922 TO THAT <br /> CODE. <br /> <br /> The City of Eugene does ordain as follows: <br /> <br /> Section 1. The definition for "Open alcoholic beverage container" in Section 4.105 <br /> <br />of the Eugene Code, 1971 is amended to provide: <br /> <br />4.105 Definitions. The following words and phrases, as used in sections 4.115 to <br /> 4.235 shall mean: <br /> <br /> Open alcoholic beverage container [A "'-'"*o; ...... ~;"~ "'-'"*o; .... ] Any <br /> bottle, can or other receptacle containing any alcoholic liquor, hard liquor, <br /> or malt beverage, which has been opened, or a seal broken, or the <br /> contents of which have been partially removed r~,~, ,,~, ~,, <br /> ~r~ I~r~l~ r,~n~ nl~ r,, ,n~ r~r r~H~r r,r~n~in~r~ r,~n~l~l~ <br /> <br /> Section 2. Section 4.710 is added to the Eugene Code, 1971, to provide: <br /> <br />4.710 Telephonic Harassment. A telephone caller commits the crime of <br /> telephonic harassment if the caller intentionally harasses or annoys <br /> another person: <br /> (1) By causing the telephone of the other person to ring, such caller <br /> having no communicative purpose; or <br /> (2) By causing such other person's telephone to ring, knowing that <br /> the caller has been forbidden from so doing by a person <br /> exercising lawful authority over the receiving telephone. <br /> <br /> Section 3. Section 4.728 is added to the Eugene Code, 1971, to provide: <br /> <br />4.728 Recklessly Endanqerin.q Another Person. A person commits the crime <br /> of recklessly endangering another person if the person recklessly <br /> engages in conduct which creates a substantial risk of serious physical <br /> injury to another person. <br /> <br /> Section 4.
