ORDINANCE NO. 20245 <br /> <br />AN ORDINANCE CONCERNING THE CRIMES OF <br />HARASSMENT, T~SPASS, VIOLATION OF PRIVACY, <br />INI'ERFERING WITH A POLICE OFFICER, AND <br />INTERFERING WITH PUBLIC TRANSPORTATION; <br />AMENDING SECTIONS 4.726, 4.808, 4.810, 4.907 AND 4.990, <br />AND ADDING SECTION 4.977 OF THE EUGENE CODE, <br />1971. <br /> <br /> THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br /> <br /> Section 1. Subsections (1)(c) and (2) of Section 4.726 of the Eugene Code, 1971, are <br />amended as follows: <br /> <br />4.726 Harassmem. <br /> (1) A person commits the crime of harassment if the person intentionally: <br /> (c) Subjects another to alarm by conveying a telephonic, electronic or <br /> w~ritten threat to inflict serious physical injury on tha:r person or to commit a felony <br /> involving the person or property of that person or any member of that persor~'s family, <br /> which threat reasonably would be expected to cause alarm. <br /> (2) A person is criminally liable fbr harassment if the person knowingly permits <br />any telephone or electronic device under the person's control to be used in violation of subsection <br />(1) of' this section. <br /> <br />Section 2. Section 4.808 of the Eugene Code, 1971, is amended as fbllows: <br /> <br />4.808 <br /> <br />person: <br /> <br />premises if: <br /> <br />Criminal Trespass in the First De rgr~. <br />(1) A person commits the crime of criminal trespass in the first degree if the <br /> <br /> (a) Enters or rernains unlawfhlly in a dwelling; or <br /> (b) Enters or remains -tmlawfully in or upon premises that have been <br />determined to be not fit for use under ORS 453~855 to 453.912 as provided by <br />administrative rules adopted by the city manager under section 2.019 of this code. <br />(2) Subsection (1)(b) of this section does not apply to the ow~aer of record of the <br /> <br /> (a) The owner enters or remains on the premises fbr the purpose of <br />inspecting or decontaminating the premises or lawfully removing ~tems from the <br />premises; and <br /> (b) The owner has not been arrested for, charged with or convicted of a <br /> <br />Ordinance- 1 <br /> <br /> <br />
