ONS~S~NCy WiTH THE STAIEWIDE PLANNING GgALS AND TRANSPORTATION PLANNING RULE <br /> <br /> of Engineers, and U.Si Fish and Wildlife Service; and the Oregon Department of Transportation, <br /> Division of State La~ds, Department of Agriculture, and Department of Fish and Wildlife~ As a <br /> consequence of these coordination efforts, numerous alternatives were carefully studied for their <br /> impacts and viability. The Modified Project is the result of that coordination, reflecting in particular, <br /> and accommodating as much as possible, the identified interests of protecting higher value wetlands <br /> and threatened and endangered (T&E) plant and animal speciesl2 while meeting regional and <br /> storewide transportation and economic development needs and highway design and safety standards. <br /> This coordination effort is consistent with and satisfies Goal 2 requirements. <br /> <br /> The Modified Project also satisfies Goal 2 consistency requirements as it is consistent with <br /> acknowledged Lane Count*./and City of Eugene comprehensive plan provisions providing for a four- <br /> lane limited access highway extending westerly from Beltline Highway to Highway 126 west of <br /> Goble Lane. Consistency with other specific City and County plan provisions is demonstrated at <br /> pages 58 through 105 of the Land Use Technical Report, incorporated herein by this reference. <br /> Inconsistent provisions associated with the Approved Design will be eliminated through the <br /> amendments to the relevant City and Count3, comprehensive plans taken to relocate the alignment as <br /> shown for the Modified Project. Those amendments include map changes, alignment descriptions and <br /> the goal exceptions described below. <br /> <br />An adequate fhctual base supporting the alignment shift from the Approved Desi~ to the Modified <br />Project, including exceptions to Goals 3, 4, 11, and 14, is set out in a variety of documents contained <br />in the record of this matter, including but not limited to the SDEIS, the Land Use TechnicaIReport, <br />the Supplemental Needs Analysis, the Alternatives Memorandum, the Compatibility with Adjacent <br />and Surrounding Land Uses in the WEP Project Area Technical Memorandum (August 1999) <br />("Compatibility g~emorandum'), the 1999 Oregon Highway Plan, and the Interim Corridor Strategy <br />for Highway 126 West (April, 1998). Testimony from ODOT and its consultant at the public hearings <br />to consider plan amendments modifying the alignment from the Approved Design to the Modified <br />Project also wilt provide additional evidence to support the alignment shift to the Modified Design. <br /> <br />A policy choice to construct a four4ane limited a " <br /> ccess West Eugene Parkway" was previously made <br />and remains a part of the acknowledged County and Metro area comprehensive plans. The decision to <br />alter the alignment does not affect that ultimate policy choice. <br /> <br />For all of these reasons, this plan amendment complies with Goal 2 Part 1. <br /> <br />Goa~ 2 Part Il <br />~[he Goal 2 exceptions standards apply in circumstances where a land use decision would otherwise <br />violate one or more goals. Under Goal 2 and ORS 197.732(1), <br /> <br /> "A local government may adopt an exception to a goal when: <br /> <br /> "(c) The following standards are met: <br /> <br /> "(1) Reasons justify why the state policy embodied in the applicable goals should not <br /> apply; <br /> <br /> "(2) Areas which do not require a new exception cannot reasonably accommodate the <br /> use; <br /> <br />12 As used in th~ memorandum, T&E species ~nclude sens~ve specJes and specJes under consideration for listing. As part of <br />f~e C~ of Eugene's current po(icy amendments~ the C~ ~ replacing the term ~threatened and endangered" w~th the term <br />"rare~ in the ~. Th~s is a term that appears in the Oregon Natural Hedtage Program database.
