<br />March 11, 2019, Meeting – Item 3E <br />EUGENE CITY COUNCIL <br />AGENDA ITEM SUMMARY <br /> <br /> Adoption of an Ordinance Providing for Withdrawal of Annexed Properties from the Following Special Districts: the Santa Clara Rural Fire Protection District; Santa Clara Water District; Willakenzie Rural Fire Protection District; Lane Fire Authority; River Road Parks and Recreation District; and River Road Water District <br /> Meeting Date: March 11, 2019 Agenda Item Number: 3E Department: Planning and Development Staff Contact: Jenessa Dragovich <br />www.eugene-or.gov Contact Telephone Number: 541-682-8385 <br /> <br />ISSUE STATEMENT The City Council is scheduled to take action on this request for the annual withdraw of previously annexed properties from special districts. <br />BACKGROUND The purpose of the ordinance is to remove annexed properties from the tax rolls of special service districts, which in this case are Santa Clara Rural Fire Protection District, Santa Clara Water District, Willakenzie Rural Fire Protection District, Lane Fire Authority, River Road Park & Recreation District, and River Road Water District. State law and local code require annexed properties to withdraw from special service districts through a separate process after the annexation of those properties becomes effective. Annexation of these properties was approved by City Council over the previous year, at the request of the property owners. The City is now providing urban services to these properties; however, they remain on the tax rolls of special service districts until withdrawn. Withdrawals come before the City Council on an annual basis. Properties annexed during the previous year are batched together to facilitate this process. The 2019 batch contains seven annexations approved by City Council in 2018—for a total of 10 tax lots Withdrawals are time-sensitive. State law provides that, if a withdrawal is not approved prior to March 31, the withdrawal does not become effective until July 1 of the following year (i.e., 2020 for these properties). This delay would mean that the properties will remain on the tax roll of the special service districts that no longer provide services to the property for more than a year. Approving the withdrawal ordinance prior to Mar. 31, 2019 will result in the withdrawals taking effect on July 1, 2019 and those properties being included on the City tax roll immediately thereafter. The City is already providing urban services to these properties. <br />
