<br /> <br />ECC <br />UGENE ITY OUNCIL <br />AIS <br />GENDA TEM UMMARY <br /> <br /> <br /> <br /> <br />Public Hearing: Annexation Request for Eugene School District 4J (A 08-1) <br /> <br /> <br />Meeting Date: September 15, 2008 Agenda Item Number: 3 <br />Department: Planning and Development Staff Contact: Alissa Hansen <br />www.eugene-or.gov Contact Telephone Number: 541/682-5508 <br /> <br /> <br /> <br /> <br />ISSUE STATEMENT <br /> <br />This public hearing is on a request to annex a parcel of land located on the east side of Coburg Road, <br />north of Kinney Loop, south of Game Farm Road, and included on Tax Lot 102 of Assessor’s Map 17- <br />03-16-22. The applicant requests annexation of a portion of Tax Lot 102 as shown on Exhibit B of <br />Attachment A. The Planning Director recommends that the City Council approve this annexation <br />request, pursuant to Eugene Code (EC) 9.7820(1)(d)(1). <br /> <br /> <br />BACKGROUND <br />In December 2007, the City Council adopted an ordinance establishing the procedures for annexation <br />requests. EC 9.7820(1)(d) provides for the council to adopt a resolution approving, modifying and <br />approving, or denying the application for annexation. Alternatively, this section also provides the option <br />for the council to hold a public hearing before consideration of the annexation request. Approval of <br />annexation applications are based on the criteria at EC 9.7825 which require that (1) the land proposed <br />to be annexed is within the city’s Urban Growth Boundary (UGB) and is contiguous to the city limits or <br />separated from city limits only by a right-of-way or water body; (2) the proposed annexation is <br />consistent with the applicable policies in the Metro Plan and in any applicable refinement plans and (3) <br />the proposed annexation will result in a boundary in which the minimal level of key urban facilities and <br />services can be provided in an orderly, efficient, and timely manner. <br /> <br />On July 14, 2008, the City Council voted to defer action on the proposed annexation until after it holds a <br />public hearing as allowed under EC 9.7820(1)(d)2. Accordingly, this September 15, 2008, a public <br />hearing was scheduled and public notice was provided in accordance with EC 9.7820(2)(d). No written <br />testimony has been received. As discussed in the attached findings, the proposed request complies with <br />the approval criteria, being located within the urban growth boundary and contiguous to city limits, and <br />given that the minimum level of key urban services can be provided. Additionally, this request is only <br />for annexation and does not include a specific development proposal; the approval criteria for <br />annexations do not require a specific development plan. However it is noted that the annexation <br />application form indicates that the plans for future development include future school facilities. <br /> <br />Approval of an annexation request requires the City to adopt a resolution. To comply with the Charter <br />requirements for resolutions, a draft resolution approving the requested annexation has been prepared <br />and is attached for reference (Attachment A). The Planning Director’s findings, which provide analysis <br />of the proposal’s compliance with applicable approval criteria, are attached to the draft resolution as <br />Exhibit C.
