CITY OF EUGENE INTER DEPARTMENTAL MEMO NDUM C~T¥ ATTORNEY -CIVIL DEPARTMENT To: Kate Fietand, Deputy City Recorder Date: June 5, 2003 Subject: Se~fvener Error Correction to EC 9.8055 and 9~8865 We have been advised that an ~endment to EC 9.8865(4) as contained in Section 4 of Ordin~ce 20275 did not get codified into the latest Code revision and we were asked whether this omission and an error in the order of EC 9.8055 subsections (e) and (d) couid be corrected as scrivener eh'ors. Although the omission with respect to EC 9.8865(4) was a codification error as opposed to a scrivener error, in the corn-se of reviewing th/s request we deten2ined that there was also a scrivener error '~,4th respect to this amendment. Section 4 of Ordinance 20275 direcmd that a new subsection(j) be added and the remaining subsections relettere& Ordinance 20271 had previously added a new subpara~aph (g) to this section mad relettered those that followed. To remain consistent with the manner of listing the sections, this ordinance should have directed that a new subsection (~)be added. You are therefore requested to effect the 5~llowing scrivener error corrections to EC 9.8055, EC 9.8865, ~d the respective Ordinances: In SUbsection (1) ofEC 9~8055, do not chmage the order in which the s~abparagraphs appear, but correct (e) and (d) so they are in alphabetical order~ Lnsert the amendment contained in Section 4 of Ordinance 20275 in EC 9.8865(4), with the subpara~aph lettered (k) (instead of 0)) and reletter the following subparagraphs accordingIy. These corrections are autho~zed by Section 43 of Ordinance 20249, which readopted and amended Ordinance 20224 on May 8, 2002, and Section 8 of Ordinance 20275.
