One property, (Jones, Tax Lot #17042000 03800), was assessed for sidewalks, but not 1:hr <br />paving improvements on Royal Avenue. Although the property is a comer lot which, by Eugene <br />Code definition, takes primary access off of Royal Avenue and would otherwise be assessed for <br />paving and related improvements, pursuant to E.C. 7.175(1)(a), it was decided to assess the property <br />only for sidewalks because the property has already been developed, its driveway access is off of <br />Terry Street, it has previously been assessed for the long frontage on Terry Street, and additional <br />driveways off of the minor arterial of Royal Avenue are not desirable. <br /> <br /> The actual cost of the local improvement is ascertained to be $503~33T95, and the amounts <br />to be assessed to and borne by the specially benefitted property and to be borne by the City or others <br />have been determined in accordance with applicable provisions of the Eugene Code, 1971 ("E.C?') <br />and as set ~brth in Exhibit A attached hereto and incorporated herein by reference. <br /> <br /> The City Council has established the method of calculating local improvement assessments <br />in E.C. 7.170 and 7.175. <br /> <br /> A public hearing on this ordinance, as required by Section 28(2) of the Eugene Charter of <br />2002, was scheduled before the hearing official as authorized by Section 2~007(4)(b) of the Eugene <br />Code, 1971, on April 9, 2003. A notice containing the information required by E~C. T185 was <br />posted on a public bulletin board at Cky Hall and given by certified ma~l to the owners of the parcels <br />of real property subject to the assessment more than ten working days prior to the scheduled public <br />hearing before the hearing officiak At the time and place specified therein, the heatings official <br />considered the assessment report of the City Engineer and Finance Officer and the testimony and <br />evidence presented at the hearing. <br /> <br />Ordinance ~ 2 <br /> <br /> <br />
