Urban Facilities Plan is automatically amended to apply the ND-Nodal Development designation to <br />the properties within the bom~dary of that plan identified and described on Exhibit A. <br /> <br /> Section 3, Consistent with the provisions of EC 9.7750(4), the Whiteaker Plan land use <br />d~agram located following page 36 of the Whiteaker Plan is automatically amended to apply the ND- <br />Nodal DevelOpment designation to the properties within the boundary of that plan identified and <br />described on Exhibit A. <br /> <br /> Section 4, The Eugene Overlay Zone Map is arr~ended to add the/ND Nodal Development <br />overlay zone to the properties identified and described on Exhibit B. <br /> <br /> SeetiogS. The above findings, and the Legislative Findings set forth in Exhibit C attached <br />hereto are adopted in support of this Ordinance. <br /> <br /> Section 6~ If any section, subsection, sentence, clause, phrase or portion of this Ordinance <br />is for any reason held invalid or ~mconstitutional by a court of competent jurisdiction, such portion <br />shall be deemed a separate, distinct and independent provision and such holding shall not affect the <br />validivy of the remaining portions thereof. <br /> <br /> Section 7~ Notw/thstanding the effective date of ordinances as provided in the Eugene <br />Charter of 2002, this Ordinance shall become effective 30 days from the date of its passage by the <br />City Council and approval by the Mayor, or upon the date of its acknowledgment as provided by <br />ORS 197.625, whichever date is later, provided that by that date the Lane County Board of <br />Commissioners has adopted an ordinance containing identical provisions to those described in <br />Sections 1 and 2 of this Ordinance. <br /> <br />Passed by the CiW Council this <br /> <br />Approved by the Mayor this <br /> <br />12t~ day of May, 2003 <br /> <br />Dep'uty C~ty Recorder <br /> <br />day of May, <br /> <br />~or <br /> <br />Ordinance - 3 <br /> <br /> <br />
