Ordinance Exhibit DOrdinanceExhibitD
DOWNTOWN RIVERFRONT
LAND USE COMPONENTS
CA 19-1,RA 19-1,Z 19-5,WG 19-3,ST 19-3,and SDR 19-2 April 19,2019
Residential/Mixed Use Area, and the area beneath and east of the viaduct is designated Mixed Use
Area. The entire site area is designated with a Nodal Development Area overlay. The area east of the
viaduct is also within the Willamette Greenway.
Th<M PI defines the High Density Residential (HDR)designation as areas of predominantly
residential use that are developed at a density of more than 20 dwellings units per gross acre.
The Mixed Uses designation identifies "areas where more than one use might be appropriate, usually
as determined by refinement plans on a local level."The EWEB Downtown Riverfront Specific Area
Plan, which is being repealed as part of the comprehensive application package, provided such
direction and it was subsequently adopted as the S-DR code standards. The Metro Plan notes that "[i]n
the absence of a refinement plan, the underlying plan designation shall determine the predominant
land use."The Specific Area Plan recognized that the area is appropriate for a mixture of uses, thereby
broadening the potential development options in the area designated for HDR.
The Nodal Development Area Overlay is intended to create "a mixed-use pedestrian-friendly land use
pattern that seeks to increase concentrations of population and employment in well-defined areas
with good transit service,a mix of diverse and compatible land uses, and public and private
improvements designed to be pedestrian and transit oriented."
The subdivision creates lots that enable development that is consistent with the plan designation and
overlays,as described above.
There are five adopted Metro Plan policies at EC 9.9560,however only Policy (5)is potentially relevant
to the subject proposal:
(5J Environmental Design Element.Natural vegetation,natural water features,and
drainage ways shall be protected and retained to the maximum extent
practicable,considering the economic,social,environmental,and energy
consequences in the design and construction of urban developments.Landscaping
shall be utilized to enhance distinctive natural features.(Policy 2,page III-E-3)
The Metro Plan policies are largely directed at the City for purposes of legislative actions and are not
intended to be approval criteria for development proposals. The City of Eugene has implemented this
policy guidance through the inventory and analysis of Goal 5 Resources,as well as the adoption of the
/WR Water Resources Conservation Overlay zone. The site is subject to both and each is addressed
herein.
It is worth noting that the site (specifically, the land area within the tentative subdivision plat)does
not include any significant natural vegetation, water features,or drainage ways.As described in the
findings associated with (l)(a),above, the site is developed with buildings and paved or gravel parking
areas. The larger area subject to the S-DR zone includes such features, including the Willamette River
riparian corridor,in the publicly owned riverfront park. The details of the proposed park
development and riparian enhancements (e.g.,removal of select rock rip-rap,restored native
plantings,re-contoured river bank)are included in the separate Standards Review land use
application.
EC 9.9500 Adopted Plan Policies. The adopted plan policies set forth in the sections beginning
at EC 9.9500 shall be used when applicable for purposes of evaluating applicable
adopted plan policies pertaining to subdivisions, partitions, and site review.
City of Eugene FINAL SUBMITTAL 67July 22, 2019, Work Session – Item 3
