Ordinance Exhibit DOrdinanceExhibitD <br />DOWNTOWN RIVERFRONT <br />LAND USE COMPONENTS <br />CA 19-1,RA 19-1,Z 19-5,WG 19-3,ST 19-3,and SDR 19-2 April 19,2019 <br />Planned construction projects involve (1)mass grading for the streets and utilities and riparian <br />enhancement for the park area,and (2)park construction and further infrastructure development. <br />The mass grading project will include riparian enhancement of the riverbank to lay back the bank to a <br />gentler slope and grading to achieve design subgrade for the park area,streets,and utilities.The <br />design includes provisions for managing environmental contamination that may be encountered <br />below the soil surface.Contaminated media will be removed to below the proposed subgrade surface <br />and the area will be capped to prevent direct exposure.Excavated contaminated soil will be managed <br />in accordance with DEQ requirements.Anticipated management options include the beneficial reuse <br />of soil as site fill below development surfacing (roads,sidewalks,concrete slabs)or disposed offsite at <br />a landfill. <br />The park construction and infrastructure development projects will involve excavation,relocation and <br />removal/abandonment of existing utilities,roadway subgrade preparation,road and sidewalk <br />construction,and park construction including a retaining wall and new pedestrian and bike paths. <br />Final surfaces include concrete or asphalt paving,concrete walls,and imported topsoil over existing <br />soil subgrade.Site development features will prevent contact with any remaining low-level <br />contamination that may remain at the site,improving the health of the site.Construction of bike and <br />pedestrian paths will improve a critical bike commuting corridor,which offsets vehicle traffic in <br />downtown Eugene. <br />In addition to the physical improvements discussed above,the planned construction projects change <br />the land use from a public utility operations yard to mixed-use development and park,thus activating <br />the area and creating a cleaner and safer human environment.Additionally,future development of the <br />site will be required to adhere to existing policies and Best Management Practices (BMP)in the Citv of <br />Eugene Stormwater Management Plan.Compliance with BMP's will be ensured through the building <br />permit process. <br />The proposal includes amendments to EC 9.6792 Stormwater Quality regulations,as included in <br />Exhibit A:Code Amendments.The proposed amendments will not have an impact on the City's <br />existing water quality protection level,which complies with State and Federal regulations.The <br />proposed amendments ensure that treatment for stormwater quality will be ensured consistent with <br />current EC standards and the administratively adopted City of Eugene Stormwater Management <br />Manual.The proposed amendments modify current regulations to allow for the combined stormwater <br />treatment facilities from both public and private development,to the extent that added capacity can be <br />achieved in the shared system to be constructed on the subject site. <br />The proposed amendments do not negatively affect the environmental factors specified in Goal 6. <br />Therefore,the proposed amendments are consistent with Statewide Planning Goal 6. <br />Goal 7 -Areas Subject to Natural Hazards:To protect people and property from <br />natural hazards. <br />Goal 7 requires local governments to adopt comprehensive plans to reduce risk to people and property <br />from natural hazards such as floods,landslides,earthquakes,tsunamis,and wildfires.The City <br />protects people and property from natural hazards through various land use and building code <br />requirements.The proposal does not alter these protective provisions,nor does it propose <br />development in areas identified to be unsuitable for development.Therefore,the proposed <br />amendments are consistent with Statewide Planning Goal 7. <br />Goal 8 -Recreation Needs:To satisfy recreational needs of the citizens of the state <br />City of Eugene FINAL SUBMITTAL 21July 22, 2019, Work Session – Item 3
