Ordinance Exhibit D <br />DOWNTOWN RIVERFRONT <br />LAND USE COMPONENTS <br />CA 19-1, RA 19-1, Z 19-5, WG 19-3, ST 19-3, and SDR 19-2 April 19, 2019 <br />Avenue in the form of a shelter constructed to provide shade, reflect the river in the roof construction, <br />and create a platform for temporary art. Temporary art opportunities may include sculpture, <br />performance art, digital visual art and more with the structure scheduled to include lighting, a <br />projection screen, and other technology to facilitate public, creative endeavors. <br />The Riverfront Park design also includes benches, seating areas, and requisite trash receptacles and <br />bicycle racks provide basic park amenities critical to public access and enjoyment of the park. <br />Proposed seat walls, stairs, and shaded seating structures will provide a variety of seating <br />opportunities for park visitors. In addition, park lighting will provide safe night-time bicycle and <br />pedestrian movements through the site and accommodate evening programming and community <br />activities. Lighting proximate to the river along the pedestrian paths and at the overlooks will strike a <br />balance between operating at lower light levels to be responsive to sensitive habitat areas, but bright <br />enough to maintain a level of security critical to the overall success of the park and visitor comfort in <br />accordance with the standards at EC 9.3155(10)(c). <br />The proposed circulation system and amenities within the subject site are intended to facilitate public <br />access through the subject site and along the Willamette River while simultaneously providing visual <br />access. Based on the above findings, the proposal ensures the continued provision of necessary and <br />adequate public access along the river. Therefore, this criterion is satisfied. <br />(3) The intensification, change of use, or development will conform with <br />applicable Willamette Greenway policies as set forth in the Metro Plan. <br />Findings of compliance with applicable Metro Plan Willamette Greenway policies are included under <br />EC 9.8065(2) and are incorporated by reference herein. Based on these findings, this criterion is <br />satisfied. <br />(4) In areas subject to the Willakenzie Area Plan, the intensification, change of <br />use, or development will conform with that plan's use management <br />considerations. <br />The subject site is not located within the boundaries of the Willakenzie Area Plan. This criterion does <br />not apply. <br />(5) In areas not covered by subsection (4) of this section, the intensification, <br />change of use, or development shall conform with the following applicable <br />standards: <br />(a) Establishment of adequate setback lines to keep structures separated <br />from the Willamette River to protect, maintain, preserve, and enhance <br />the natural, scenic, historic, and recreational qualities of the Willamette <br />Greenway. Setback lines need not apply to water related or water <br />dependent activities as defined in the Oregon Statewide Planning Goals <br />and Guidelines (OAR 660-15-000 et seq.). <br />As illustrated on Sheets L1.0 and L1.1 Site Plan (Exhibit B.1), the proposal includes the establishment <br />of a Willamette Greenway setback line to keep structures separated from the river and to protect, <br />maintain, preserve, and enhance the natural, scenic, historic, and recreational qualities of the <br />Willamette Greenway.
