ADMINISTRATIVE ORDER NO. 44-19-01-F <br />of the <br />City Manager of the City of Eugene <br />AMENDMENT OF THE ASSESSMENT ACCOUNTS FEE SCHEDULE <br />ADOPTED BY ADMINISTRATIVE ORDER NO. 44-09-09-F REGARDING <br />SDC INTEREST CHARGES FOR DEVELOPMENT OF A MID-TOWN <br />ARTS CENTER. <br />The City Manager of the City of Eugene finds that: <br />A. Section 2.020 of the Eugene Code, 1971, authorizes the City Manager to <br />determine and set fees and charges to be imposed by the City for services, goods, use of <br />municipal property, and licenses and permits. Sections 2.022 and 2.023 of that Code authorize <br />the City Manager to establish the interest rate to be charged on sums due the City. <br />B. On May 11, 1983, Administrative Order No. 44-83-01 was issued establishing <br />interest rates. On January 12, 2010, I issued Administrative Order No. 44-09-09-F which <br />amended Administrative Order No. 44-83-01 by updating the rates for Assessment Accounts. <br />C. On June 10, 2019, the City Council approved the City Manger's recommendation <br />that the City pay the non-residential portion of tl)e Midtown Art Center's SDCs from property <br />tax revenue that the city will receive from the construction of the Center. <br />D. In order to ensure that the City's SDC fund is able to pay for the infrastructure <br />upon which the City's SDC methodology is based, the City intends to make the SDC fund whole <br />by paying the Mid-Town Art Center's local waste water, stormwater, transportation, and <br />parks/recreation systems SDCs with property tax revenue that the City will receive from the <br />construction of the Mid-Town Art Center. Since any property tax revenue from the Mid-Town <br />Art Center not needed for payment of the SDC fees will go to the general fund, City payment of <br />interest on the owed SDCs is not in the best interest of the City. <br />E. Pursuant to the above findings, on June 27, 2019, I issued Administrative Order <br />No. 44-19-01 ordering that notice be given advising the public of the opportunity to submit <br />comments on my proposal to amend the Assessment Accounts Fee to provide that there is 0 <br />(zero) interest charged pursuant to the Assessment Accounts Fee Schedule for the Mid-Town Art <br />Center's SDCs for local waste water, storm water, transportation, and parks/recreation systems. <br />The Notice specified that comments would be received for 15 days from the date of posting of <br />the Notice. No comments were received in response to the Notice. <br />F. Pursuant to section 2.020 of the Eugene Code, 1971, in consideration of this <br />proposal, I have considered, as relevant: applicable policies, enactments and directives of the <br />council; the amount charged by the city in the past; the full costs of providing the service <br />supported by the rates; the amounts charged by other comparable providers; and the revenue <br />needs of the city as determined by the adopted city budget. <br />Administrative Order -Page 1 of 2
