Councilor Kelly said he would oppose both ordinances. He stressed the importance of addressing the Land Use Board of Appeals (LUBA) remanded issues of tree provisions and the needed housing path. He said he was voting against the ordinances as a way of showing his frustration that those issues had been ignored by staff. The main motion passed unanimously, 7:0. City Manager Carlson asked the council to consider Council Bill 4807 by number only. Councilor Kelly, seconded by Councilor Pap~, moved that the bill be approved and given final passage. Roll call vote; the motion passed, 6:1; Councilor Kelly voting in opposition. City Manager Carlson asked the council to consider Council Bill 4808, an ordinance concerning secondary dwellings and flag lots; amending sections 9.2741, 9.2750, 9.2751, and 9.2775 of the Eugene Code, 1971; adopting a severability clause; and providing an effective date. Councilor Kelly, seconded by Councilor Pap~, moved that the bill, with unanimous consent of the council, be read a second time by Council Bill number only and that enactment be considered at that time. Councilor Bettman said she would vote against the ordinance. She said she was opposed because reducing the setbacks in R-1 and R-2 would be counter-productive to attempts to not expand the urban growth boundary and make the urban core attractive and livable. Councilor Taylor said she would vote against the ordinance because the things that the council had wished to vote on first had been neglected. She said the reductions to setbacks were destroying the livability of neighborhoods. Councilor Rayor said he would support the ordinance because flag lots were a unique type of lot. He said the reduced setbacks were more equivalent to the normally established set backs along the side of the lots. He said flag lots were common and needed to be utilized. Councilor Nathanson said she would support the ordinance. She said it was a growth management issue that had solicited people for input. Councilor Pap~ said he would support the ordinance. Councilor Meisner said he would support the ordinance. The motion passed unanimously, 7:0. City Manager Carlson asked the council to consider Council Bill 4808 by number only. Councilor Kelly, seconded by Councilor Pap~, moved that the bill be approved and given final passage.
