<br /> <br />The Measure 37 impacts of this ordinance are unknown. It is possible that claims could be made by <br />owners of property that is now designated Medium Density Residential, and thus eligible for R-2 <br />zoning, if the City changes the designation to Low Density Residential, thereby restricting the eligibility <br />for R-2. In general, all new regulations that restrict land use have the potential to be the basis for such <br />claims. <br /> <br /> <br />RELATED CITY POLICIES <br />Numerous Metro Plan and Jefferson/Far West Refinement Plan Policies apply to the proposal and are <br />part of the applicable review criteria addressed in the preliminary findings (Attachment A, Exhibit C). <br /> <br /> <br />COUNCIL OPTIONS <br /> <br />There are no council options to consider at this time. Eugene Code requires a public hearing before the <br />City Council on Metro Plan Amendments, Refinement Plan Amendments, and Code Amendments. The <br />council initiated the proposed amendments by motion on September 11, 2006. City Council options will <br />be prepared when the item is scheduled for action. <br /> <br /> <br />CITY MANAGER’S RECOMMENDATION <br /> <br />The City Manager recommends that the City Council take testimony on this item at a public hearing, per <br />the process requirements of the Eugene Code. The item is scheduled for action on March 12, 2007. <br /> <br /> <br />SUGGESTED MOTION <br /> <br />There is no suggested motion as this is a public hearing only.
