Findings Addressing ORS 197.312(5) September 3, 2019 13 <br /> <br /> <br />measures for the existing single-family neighborhoods surrounding the University of Oregon (Amazon, <br />Fairmount and South University), which have in recent years experienced a substantial increase in <br />unforeseen housing development associated with the skyrocketing demand for private student housing <br />in the proximity of the university. Residents of those neighborhoods supported this regulation as a way <br />to help make the new development less impactful on the livability of the neighborhood. Livability is an <br />important Statewide Planning Goal 14 concept, along with accommodating the need for compact <br />development. <br /> <br />As part of Envision Eugene, the city is committed to completing area planning for the university area <br />neighborhoods, including consideration of specific design standards for housing to addresses impacts <br />from proximity to the University of Oregon. The interim protection measures are intended to limit <br />further negative impacts until the area planning process is completed. It is expected that these interim <br />measures will be replaced by a more comprehensive set of development and design standards <br />established as part of the area planning effort. <br /> <br /> <br />Building Height/Sloped Setback <br /> <br />9.2751 Special Development Standards for Table 9.2750. <br />(3) Building Height. <br /> (d) An additional 7 feet of building height is allowed for roof slopes of 6:12 <br />or steeper in the R-1, R-2, R-3 and R-4 zones, except that this additional <br />building height allowance is not permitted in the R-1 zone for accessory <br />dwellings, accessory buildings or development on alley access lots. <br /> <br />(17) Accessory Dwellings. <br />(a) General Standards for Attached Accessory Dwellings. Except as <br />provided in subsection (c) below, accessory dwellings that are within the <br />same building as the primary dwelling shall comply with all of the <br />following: <br />3. Building Height/Interior Setback. Except for accessory dwellings <br />on flag lots (see EC 9.2775), the following standards apply: <br />a. For attached accessory dwellings located within 60 feet of a <br />front lot line, interior yard setbacks shall be at least 5 feet, <br />and maximum building height shall be limited to that of the <br />main building as per Table 9.2750 <br />b. For attached accessory dwellings located greater than 60 <br />feet of a front lot line, interior yard setbacks shall be at least <br />5 feet. In addition, at a point that is 8 feet above finished <br />grade, the setback shall slope at the rate of 10 inches <br />vertically for every 12 inches horizontally away from the <br />property line to a maximum building height of 18 feet. (See <br />Figure 9.2751(16)(b)3.) <br />c. The allowances for setback intrusions provided at EC <br />9.6745(3) do not apply within the setback described in <br />subsections a. and b. above, except that eaves and <br />chimneys are allowed to project into this setback no more <br />than 2 feet. <br /> <br /> (b) General Standards for Detached Accessory Dwellings.
